<br />. <br /> <br />. <br /> <br />. <br /> <br />CITY OF ARDEN HILLS <br />RAMSEY COUNTY <br /> <br />RESOLUTION NO. 94-67 <br /> <br />RESOLUTION ESTABLISHING A SEPARATE ACCOUNT FOR CABLE FRANCHISE <br />FEES AND SPECIFYING THAT THE FUNDS IN THE ACCOUNT MAY <br />ONLY BE USED FOR CABLE-RELATED ACTIVITIES <br /> <br />WHEREAS, the City of Arden Hills is a member of the North Suburban Cable <br />Communications Commission, which was established by a Joint and Cooperative <br />Agreement between the Cities of Arden Hills, Falcon Heights, Lauderdale, Little <br />Canada, Mounds View, New Brighton, North Oaks, Roseville, S1. Anthony and <br />Shoreview, pursuant to Minnesota Statutes Section 471.59; and <br /> <br />WHEREAS, the Grantee of the cable franchise pays franchise fees to the City; and <br /> <br />WHEREAS, the cable subscriber ultimately bears the cost of the franchise fees and ought to be <br />the beneficiary of their use, either in cable franchise administration or in <br />community cable television programming; and <br /> <br />WHEREAS, Article X, Section 3 of the Joint and Cooperative Agreement states that after <br />making its annual contribution to the budget ofthe North Suburban Cable <br />Communications Commission, the remainder of any franchise fee paid to the <br />Member by the Grantee shall be used for cable-related expenses; and <br /> <br />WHEREAS, the North Suburban Cable Communications Commission does, from time to time, <br />make available grants to assist the Member Cities with the purchase of video <br />equipment to be used for programming the municipal access channel and to assist <br />cities with the costs of producing a specific program or series of programs; and <br /> <br />WHEREAS, in order to be eligible for such grants, a Member City must be able to document <br />that its franchise fees have been used primarily for cable-related activities; and <br /> <br />WHEREAS, the most effective way to establish such documentation is to establish a separate <br />account for franchise fees and specifying that the funds in this account may only <br />be used for cable-related activities. <br /> <br />NOW THEREFORE, BE IT RESOLVED by the City Council of the City of Arden Hills, <br />Minnesota: <br />1, That the City will establish a separate account for franchise fees, or their <br />equivalent. <br />
