<br />. <br /> <br />. <br /> <br />. <br /> <br />. - <br /> <br />CITY OF ARDEN HILLS <br />COUNTY OF RAMSEY <br />STATE OF MINNESOTA <br /> <br />RESOLUTION 99-18 <br /> <br />RESOLUTION VACATING A PORTION <br />OF THE OAK AVENUE RIGHT-OF-WAY <br /> <br />WHEREAS, the City of Arden Hills (the City) reconstructed Oak Avenue in 1996; and <br /> <br />WHEREAS, the City in preparing the plans and specifications for the reconstruction of <br />Oak Avenue, discovered that the existing roadway was not contained within the existing <br />right-of-way for Oak Avenue; and <br /> <br />WHEREAS, right-of-way was acquired on the west side of Oak Avenue to <br />accommodate the alignment; and <br /> <br />WHEREAS, tbe excess right-of-way on the east side of Oak Avenue was not vacated at <br />the time ofthe alignment; and <br /> <br />WHEREAS, the City has caused a notice of public hearing to be ~ublished in the City's <br />official newspaper for two (2) consecutive weeks (May 12th & 19t of 1999); and <br /> <br />WHEREAS, the City has notified the affected property owners by mail at least ten (10) <br />days prior to the public hearing; and <br /> <br />WHEREAS, the request to vacate was reviewed by the Arden Hills Planning <br />Commission at a public hearing on the 2nd day of June, 1999, and approved by the Arden <br />Hills City Council on the 14th day of June, 1999; and <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council ofthe City of Arden <br />Hills, Minnesota, that the City of Arden Hills hereby agrees to the vacation ofthat <br />portion of the Oak Avenue rigbt-of-way as described on Exhibit A attached hereto. <br /> <br /> <br />PASSED AND ADOPTED BY THE CITY CO <br />HILLS THIS 14TH DAY OF JUNE, 1999. <br /> <br />ATTEST: <br /> <br /> <br />Y ADMINISTRATOR <br />
