<br />. <br /> <br />. <br /> <br />. <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF ARDEN HILLS <br /> <br />RESOLUTION 98-40 <br /> <br />RESOLUTION VACATING A PORTION <br />OF THE OAK AVENUE RIGHT-OF-WAY <br /> <br />WHEREAS, the City of Arden Hills (the City) reconstructed Oak Avenue in 1996; and <br /> <br />WHEREAS, the City in preparing the plans and specifications for the reconstruction of Oak <br />Avenue discovered that the existing roadway was not contained within the existing right-of-way <br />for Oak Avenue; and <br /> <br />WHEREAS, the City determined that the alignment of the existing Oak A venue should be <br />utilized for this streets reconstruction; and <br /> <br />WHEREAS, the property owner agreed to provide the City the necessary right-of-way for this <br />reconstruction in exchange for vacating the excess right-of-way in this area; and <br /> <br />WHEREAS, the City has caused a notice of public hearing to published in the City's official <br />newspaper for two (2) consecutive weeks (Febmary 18th & 25th of 1998) and the City has <br />notified the affected property owner at least ten (10) days prior to the public hearing; and <br /> <br />WHEREAS, the request to vacate was reviewed by the Arden Hills Planning Commission at a <br />public hearing on the 4th day of March, 1998, and approved by the Arden Hills City Council on <br />the 30th day of March, 1998; and <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arden Hills, <br />Minnesota hereby agrees to the vacation of that portion of the Oak Avenue right-of-way as <br />des crib cd on Exhibit A, <br /> <br />PASSED AND ADOPTED BY THE CITY COUNCIL <WTHE CITY OF ARDEN HILLS <br />THIS 13TH DAY OF APRIL, 1998. ;j;;/ ;;/' <br />/~y)/ ,;t7 / <br />./</~ ~~ <br />IDm<rNI~)BST, MAYOR <br /> <br />ATTEST: <br />/~~;;;:/ - <br />/C------~ <br />BItIAN FRITSI~QER, CITY ADMINISTRATOR <br />
