<br />.. <br /> <br />. <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF ARDEN HILLS <br /> <br />RESOLUTION 98-70 <br /> <br />RESOLUTION VACATING A PORTION OF A <br />DRAINAGE AND UTILITY EASEMENT IN McCLUNG FIRST ADDITION <br /> <br />WHEREAS, the Property Owner (John McClung) of Outlot A of McClung First Addition has <br />subdivided this parcel as part of Planning Case 98-17; and <br /> <br />WHEREAS, the Developer has requested, as part of Planning Case 98-17, to vacate a portion of <br />the Drainage and Utility Easement, as described in Exhibit I, which encumbers this property; and <br /> <br />WHEREAS, the petition to vacate said easement was made by the Developer and the City has <br />caused a notice of public hearing to published in the City's official newspaper (June 17, 1998) <br />and the City has notified the affected property owner at least ten (10) days prior to the public <br />hearing; and <br /> <br />WHEREAS, the Planning Commission at its July 1, 1998, regular meeting conducted a public <br />hearing on the matter and recommended approval of said vacation to facilitate development on <br />. said property; and <br /> <br />WHEREAS, the City Council at its August 31, 1998, regular meeting approved said vacation to <br />facilitate development on said property; and <br /> <br />NOW, THEREFORE, BE IT RESOLVED by the City Council of the City of Arden Hills, <br />Minnesota hereby agrees to the vacation of that part of the drainage and utility easement <br />described on Exhibit I. <br /> <br />PASSED AND ADOPTED BY THE CITY COUNCI <br />THIS 30TH DAY OF NOVEMBER, 1998. <br /> <br /> <br />TY OF ARDEN HILLS <br /> <br />DE <br /> <br />ATTEST: <br /> <br />BRIAt\:(~~DMINISTRATOR <br /> <br />. <br />
