. . . ~ ~~ILLS January 27, 2003 Mr. Glenn Rotondo Deputy Regional Administrator U.S. General Services Administration 10 Causeway Street, Suite 925 Boston, MA 02222 RE: Twin Cities Army Ammunition Plant Mr. Rotondo, The City of Arden Hills has engaged in discussions with representatives of the Department of the Anny and the General Services Administration concerning the future of Twin CitiesAnny Ammunition Plant (TCAAP), an inactive military industrial facility within the City. It is our understanding that the Anny wishes to dispose of the property and that the General Services Administration is the property disposal agent. The City of Arden Hills is interested in obtaining title to TCAAP to effectuate the reuse of the property. Further, the City of Arden Hills supports a wildlife corridor consistent with the Vento Plan and the Arden Hills TCAAP Framework Plan. The normal disposal process of contaminated federal property involves the satisfaction of the provisions of Title 42, United States Code, section 9620(h)(3), which requires that the United States provide a covenant to the transferee warranting that all action necessary for the protection of human health and the environment has been taken prior to transfer. However, if certain assurances and protections can be provided, as specified in section 9620(h)(3)(C) of the above cited statute, the United States is allowed to defer the warranty and transfer title before remediation is completed. The deferral in this case must be approved by the Governor of the State of Minnesota. Given the intended development of TCAAP and the ability to incorporate remediation and site preparation for development into one process, the deferral of the statutory covenant appears to be appropriate. Further, the response action assurances required for deferral have been considered and do not present an impediment to the City's intended plans. On behalf of the City of Arden Hills, the City requests that the Anny and the General Services Administration begin negotiations to develop an arrangement for the early transfer of the property and for an environmental cooperative services agreement whereby the City performs the remaining environmental remediation work, through the City's developer, at, the property.
