<br />. <br /> <br />. <br /> <br />. <br /> <br />DEVELOPMENT AGREEMENT <br />BY AND BETWEEN THE CITY OF ARDEN HILLS <br />AND <br />TRAMM BUILDERS AND REALTORS, LLC <br /> <br />1.00 <br /> <br />Parties. This Agreement is dated the day of , 2003, and is <br />entered into by and between City Of Arden Hills, a Minnesota municipal corporation <br />(herein "City"); and the Tramm Builders and Realtors, LLC, a Minnesota limited <br />liability company, its successors and assigns (herein "Developer"). <br /> <br />2.00 <br /> <br />Prooerty Descriotion. The Developer represents that it is the record fee owner of the <br />following described property situated in Ramsey County, Minnesota, to wit: <br /> <br />Tract A, Registered Land Survey No. 496, Ramsey County, Minnesota <br /> <br />3.00 Plat Waiver/RLS Aooroval. On the day of , 2003, the City <br />Council waived the plaiting procedure for the above Property, and approved a new <br />registered land survey for the above Property, which essentially has the effect of <br />subdividing the Property. The City's action was conditioned upon the Developer <br />entering into this Development Agreement. <br /> <br />4.00 Terrris and Conditions. NOW, THEREFORE, in reliance upon the representations <br />contained herein; in compliance with the City's Zoning and Subdivision Regulations; <br />and in consideration of the mutual undertakings herein expressed, the parties agree <br />as follows: <br /> <br />4.01 Develooer Imorovements. The Developer shall construct the following <br />improvernents in compliance with plans and specifications which have been <br />reviewed and approved by the City's Consulting Engineer, which are altached <br />and incorporated herein as Exhibit A: <br /> <br />A. Site Gradina and Turf Restoration. Site grading improvements shall <br />include common excavation, subgrade correction, embankment and <br />pond excavation. Turf restoration shall include seeding, mulching and <br />erosion control. <br /> <br />1. Site Grading Improvements shall be completed prior to <br />issuance of Certificate of Occupancy. <br /> <br />2. Turf restoration improvements shall be completed prior to <br />issuance of Certificate of Occupancy. <br /> <br />B. Landscaoina. Developer shall complete all landscaping improvements <br />prior to issuance of Certificate of Occupancy. <br /> <br />C. <br /> <br />Storm Sewer. Storm sewer improvernents include all necessary storm <br />sewers, catch basins, culverts, and other apparatus. Storm sewer <br />improvements shall be completed prior to issuance of Certificate of <br />Occupancy. <br />
