[275.084] [TRANSPORTATION UTILITY FEE.] <br />Subdivision 1. [DEFINITIONS.] For the purposes of this <br />section, the fol1owinq terms have the meaninqs qiven. <br />(1) "Municipality" means a home rule charter or statutory <br />city. <br />(2) "Governinq body" means the city council of a <br />municipality. <br />(3) lfReconstruction" means pavinq, qradinq, curbs and <br />qutters, bridqe repair, overlays. drainaqe, base work, subqrade <br />corrections, and boulevard restoration. <br />(4) "Facility upqrade" means traffic siqnals, turn lanes, <br />medians, street approaches, alleys, riqhts-of-way, sidewalks, <br />retaininq walls, fence installation, and additional traffic <br />lanes. <br />(5) "Maintenance II means stripinq, seal coatinq, crack <br />sealinq, sidewalk maintenance, siqnal maintenance, street liqht <br />maintenance, and siqnaqe. <br />Subd. 2. [AUTHORIZATION.] A municipality may impose the <br />transportation utility fee provided in this section aqainst land <br />located within its boundaries. <br />Subd. 3. [PROCEDURES FOR ADOPTION.] A municipality may <br />impose the transportation utility fee provided in this section <br />by ordinance adopted by a two-thirds vote of its qoverninq <br />body. The resolution must not be voted on or adopted until <br />after a public hearinq has been held on the question. A notice <br />of the time, place, and purpose of the hearinq must be published <br />at least once in each week for two successive weeks in the <br />official newspaper of the municipality, or in a newspaper of <br />qeneral content and circulation within the municipality, and the <br />last notice must be published at least seven days prior to the <br />hearinq. The municipality, if adopted, must file the ordinance <br />of record with the county recorder, and the municipality must <br />provide a copy to the county auditor. <br />Subd. 4. [COLLECTION.] The ordinance adopted under this <br />section must provide for the billinq and payment of the fee on a <br />monthly, quarterly, or other basis as directed by the qoverninq <br />body.
