Draft Easement

Overview

As Council is aware, City Engineer Greg Brown and 0 & M Director Tom Moore have been
working with the Josephine Hills Lake Association to facilitate a water quality improvement
project on a portion of Association property. Last week staff met with representatives of the
Association and they were in general agreement with proposed project subject to several
revisions that City staff is comfortable with. At this point, the Association representatives will
bring the revised plan/project back to the full Association for a vote. This is anticipated to occur
sometime in the next few weeks.

To expedite the process, staff would like to request authorization to make an offer to the
Association for the easement in an amount not to exceed $4,650. This way, the Association will
be able to consider all facets of the easement issue at the same time. A draft of the proposed
easement is included for your review. Once finalized with the Association, staff will bring back
a final easement for the Council's review and approval.

Requested Action

1. Authorize negotiation of final drainage and utility easement in an amount not to exceed
$4,650.
