<br />e <br /> <br />. <br /> <br />. <br /> <br />~ <br />EN HILLS <br /> <br /> <br />MEMORANDUM <br /> <br />DATE: <br /> <br />Agenda Item 6.A.2 <br /> <br />April 23, 2002 <br /> <br />TO: Mayor and City Council <br /> <br />FROM: Peter Hellegers, City Plann~ <br /> <br />SUBJECT: Planning Case #03-09 <br />Bruce Gode <br />3538 Glen Arden Road <br />Variance (Zoning Ordinance) <br /> <br />Request <br /> <br />The applicant is requesting a 6-foot variance from the minimum side yard setback for one side. <br />This variance would allow construction of an attached 24' by 26' garage four feet from the <br />northern property line, Since this variance would also reduce the minimum total side yard <br />setback for the property (25 feet) to 19 feet, a variance of 6 feet from the minimum total side <br />yard setback would also be required. The applicant is requesting: <br />· A 6-foot variance from the minimum side yard setback. <br />· A 6-foot variance from the minimum total side yard setback. <br /> <br />Planninl! Commission Recommendation <br /> <br />The Planning Commission is recommending denial of Planning Case #03-09, Bruce Gode, 3538 <br />Glen Arden Road, request for a variance for the following reason: <br /> <br />· The state Statute definition of "undue hardship" is not met. In Chapter 462357, <br />Subdivision 6, (2), defines "undue hardship" as a situation where: "" .the property in <br />question cannot be put to a reasonable use if used under conditions allowed by the <br />official controls,,,", However, in this particular instance the official controls would <br />allow the applicant a reasonable use; construct a two-car garage somewhere behind the <br /> <br />PC #03-0!l- CC Memo 04/23/2003 - Page 1 of 2 <br />
