<br />This is outlined in the Development Agreement between the City and Guidant. The <br />Development Agreement will be considered for approval by the City Council in <br />conjunction with the final plat. A draft of the current Development Agreement has <br />been enclosed for the Commission's reference, However, no Commission action is <br />required. <br /> <br />. <br /> <br />3. Reconstructing "Cummings Park Drive" at Guidant's expense in accordance with plans <br />and specifications approved by the City Engineer. <br /> <br />This is outlined in the Development Agreement between the City and Guidant. The <br />Development Agreement will be considered for approval by the City Council in <br />conjunction with the final plat. <br /> <br />4. Execution of a development agreement for developer installed public improvements. <br /> <br />This condition would need to be reiterated with final plat approval <br /> <br />5. Provision of an access easement to Xcel Energy. <br /> <br />This condition would need to be reiterated with final plat approval <br /> <br />6. Compliance with applicable provisions ofthe City Code and related ordinances. <br /> <br />This condition would need to be reiterated with final plat approval <br /> <br />. <br /> <br />7. Satisfaction of the park dedication requirement as approved by the City Council. <br /> <br />This is outlined in the Development Agreement between the City and Guidant. The <br />Development Agreement will be considered for approval by the City Council in <br />conjunction with the final plat. <br /> <br />Changes from the Preliminary Plat <br /> <br />One variation from the preliminary plat is that the Final Plat contemplates two lots instead of the <br />three lot pattern. Lots I and 2 from the Preliminary Plat have been combined to form Lot 1. Lot <br />3 from the Preliminary Plat has remained relatively unchanged with the exception of the lot now <br />being described as Lot 2. The following table highlights the changes to the lot area. <br /> <br />1. Minimum Lot Area. The Zoning Ordinance in Section V, F, 2, states that the minimum <br />lot area for lots in the I-I Limited Industrial Zoning District shall be at least 30,000 <br />square feet. Both lots on the Final Plat are significantly larger than the required 30,000 <br />square feet. The numbers shown below include some property that is not counted in the <br />total size of the campus because the property was lost to easements or dedications. <br /> <br />. <br /> <br />PC #03-04 - PC Memo 022703 - Page 3 of 5 <br />
