<br />SPENCER FANE <br />B R I T T ~ B ROW N E llP <br />ATTORHEH It COUNSELORS AT LAW <br /> <br />. <br /> <br />The Firm represents a large group of PRPs performing response actions at the Fisher -Calo <br />site in Kingsbury, Indiana, where the Firm has helped its clients achieve settlements of hundreds of <br />thousands of dollars from PRPs that had declared or threatened bankruptcy. The Firm represented <br />a group of generator PRPs at the Lowry Landfill NPL site near Denver, Colorado in connection with <br />the StorageTek bankruptcy proceeding. The PRP group challenged EP A's proposal to settle its <br />claims with StorageTek in a manner that would have discharged the PRPs' cross-claims for what the <br />PRPs believed was too Iowa value. Through litigation and negotiation, the Firm eventually was able <br />to secure for the group a significantly better contribution from StorageTek. The Firm served as <br />environmental counsel representing AT&T with respect to environmental claims in American <br />Telephone and Telegraph Co. v. Chateaugay Corp., 88 B.R. 581 (S.D.NY 1988), in which the <br />court held in the L TV bankruptcy proceeding that resolution of issues involving consideration of the <br />Bankruptcy Code and CERCLA require mandatory withdrawal of reference from the bankruptcy <br />court in a bankruptcy proceeding. <br /> <br />The Firm also has represented PRP groups pursuing bankruptcy and similar claims against <br />PRPs at numerous other sites, including the Hardage site in Criner, Oklahoma, the Doepke-Holliday <br />site in Johnson County, Kansas, and a site in Chanute, Kansas. <br /> <br />On-Going Environmental Compliance and Consnlting <br />A substantial amount of the Firm's practice involves representing and counseling clients on . <br />environmental issues that arise in the course of daily business decision-making. These include matters <br />such as underground storage tanks, asbestos, community right-to-know, release reporting, and many <br />others. The Firm's clients regularly call upon Firm lawyers to give them a wide range of advice <br />concerning environmental regulations and transactions with environmental implications. Firm lawyers <br />strive to keep abreast of the rapidly changing developments in the environmental field and regularly <br />send information concerning new regulations and other recent developments to clients who request <br />it. In addition, the Firm has assisted clients in performing comprehensive self-audits to assess their <br />compliance with existing environmental requirements and improve their ability to recognize and <br />comply with future requirements efficiently and cost-effectively. <br /> <br />Types of Facilities <br />Because of its broad environmental practice group, the Firm has substantial experience in <br />addressing environmental issues at a wide array offacilities.
