<br />8.04 Extent of Owners' Easements. Except as otherwise provided herein, the . <br />rights created hereby and the title of the Association to Common Elements shall be <br />subject to the following: <br /> <br />(a) The right of the Association, in accordance with the <br />Governing Documents to improve the Property and to <br />borrow money for such purposes, and in aid thereof to <br />mortgage said Common Elements; provided, <br />however, that the rights of such mortgagee in said <br />Common Elements shall be subordinate to the rights <br />of the Owners and the First Mortgagees. <br /> <br />(b) The right of the Association to take such steps as are <br />reasonably necessary to protect the Property against <br />foreclosure. <br /> <br />(c) The right of the Association to adopt rules and <br />regulations concerning the Common Interest <br />Community as allowed by the Act and to suspend the <br />enjoyment rights of any Owner for reasonable periods <br />of time and to impose reasonable fines and penalties <br />for violations of the provisions of the Goveming <br />Documents; provided, however, that nothing . <br />contained in this Section 8.04(c) shall be deemed to <br />deny an Owner easement for ingress and egress and <br />utilities, and use and enjoyment of the Limited <br />Common Elements. <br /> <br />(d) The right of Owners to use the parking spaces; <br />subject, however, to regulation by the Association. <br /> <br />(e) The right of the Association to dedicate or transfer all <br />or any part of the Common Elements to any public <br />agency, authority or utility for such purposes as <br />provided by the Act. <br /> <br />8.05 Deleoation of Use. Any Owner may delegate, in accordance with the <br />Governing Documents, an Owner's right of enjoyment to Common Elements to its <br />tenants, but the Owner shall remain responsible for the conduct of such persons. <br /> <br />8.06 Use of Common Elements. Any Common Elements shall be used strictly in <br />accordance with the provisions of this Declaration and rules and regulations adopted by <br />the Association pursuant to the Act. Except as herein provided, no Owner shall obstruct <br />or interfere whatsoever with the rights and privileges of other Owners in Common <br />Elements, and nothing shall be planted, altered, constructed upon or removed by an . <br />Owner from Common Elements, except as provided in the Governing Documents.
