<br />contrary to the intent and meaning of the provisions . <br />hereof, and the Association shall not thereby be <br />deemed guilty in any manner of trespass provided <br />that legal proceedings must be instituted before any <br />items of construction can be altered or demolished. <br /> <br />(b) To enjoin, abate or remedy by appropriate legal <br />proceedings the continuance of any such breach. <br /> <br />(c) To impose reasonable fines on the Owner or <br />occupant of a Unit after notice and an opportunity to <br />be heard. <br /> <br />In addition to all other remedies and rights set forth in the Act, the Association, <br />and anyone or more aggrieved Owners, shall have the right of action against Owners <br />who fail to comply with the provisions of the Declaration or the decisions of the <br />Association, and one or more Owners shall also have such rights of action against the <br />Association for any failure to comply with or enforce such provisions. <br /> <br />20.02 Association Acts throuah Board. The power and authority of the <br />Association as provided in the applicable Statutes, the Governing Documents and <br />Regulations shall be vested in a Board of Directors elected by the Owners in <br />accordance with the Bylaws of the Association. The Association shall act through the . <br />Board of Directors and the officers elected by the Board. <br /> <br />20.03 Notices. Any notice required to be sent to any member of the Association <br />(or Owner) under the provisions of this Declaration shall be deemed to have been <br />properly sent when mailed, postage prepaid, to the last known address of such member <br />appearing on the records of the Association at the time of such mailing. In the case of <br />multiple Owners of a Unit, notice to anyone of such Owners shall be deemed notice to <br />all. <br /> <br />20.04 Captions. The Article and Section headings are intended for convenience <br />only and shall not be given any substantive effect. <br /> <br />20.05 Construction. In the event of an apparent conflict between this <br />Declaration and the Bylaws, the provisions of this Declaration shall govern. In the event <br />of a conflict between this Declaration and the Act, the Act shall govern. The use of <br />pronouns such as "his", "he" and "him" are for literary purposes and mean whenever <br />applicable the plural and female forms. <br /> <br />21.00 RIGHT OF FIRST REFUSAL Owners of Units which have less than a <br />majority of the votes in the Association may not convey Units to third parties without first <br />offering the Units to the Owner who has a majority of the votes in the Association. No <br />Owner shall convey a Unit to a non-govemmental entity. . <br /> <br />20 <br />
