DRAINAGE AND UTILITY EASEMENT AGREEMENT <br /> <br />THIS AGREEMENT is dated the _ day of , 2003 and is <br />entered into by and between BETHEL COLLEGE AND SEMINARY, a Minnesota non- <br />profit corporation (herein "Grantor") and THE CITY OF ARDEN HILLS, a Minnesota <br />statutory city (herein "City"). <br /> <br />Grantor represents that it is the record fee owner of the following described <br />property, situated in Ramsey County, Minnesota to wit: <br /> <br />That part of the west half of the southwest quarter of Section 27. Township <br />30. Range 23, Ramsey County, Minnesota, lying westerly of Old State <br />Highway NO.1 0 and north of the right-of-way of the Minneapolis St. Paul <br />and Sault Ste. Marie Railroad (the "Property") <br /> <br />For valuable consideration and in satisfaction of a condition imposed by the City <br />for the issuance of a development permit, the Grantor hereby conveys to the City, its <br />successors and assigns, (i) a perpetual non-exclusive easement for trailway purposes, <br />including pedestrian and bicycle use but specifically excluding any motorized use, <br />except during construction or maintenance, as hereinafter provided; and (ii) a perpetual <br />permanent drainage and utility easement, both such easements being located over. <br />across, under and through lhe following described property situated within Ramsey <br />County, Minnesota, to wit: <br /> <br />An 8.00 foot wide easement over and across the Northwest Quarter of the <br />Southwest Quarter of Section 27, Township 30, Range 23, Ramsey <br />County, Minnesota. The centerline of said 8.00 foot easement is described <br />as commencing at the most northerly corner of Lot 1, Block 1, Chatham <br />First Addition. according to the recorded plat thereof, Ramsey County, <br />Minnesota; thence on an assumed bearing of South 50 degrees 43 <br />minutes 05 seconds East, along the northeasterly line of said Lot 1 and <br />the southwesterly right of way line of Old Highway 10, formerly known as <br />Anoka Cutoff and formerly known as Snelling Avenue, a distance of <br />14921 feet to the west line of said Northwest Quarter of the Southwest <br />Quarter of Section 27; thence South 0 degrees 35 minutes 03 seconds <br />
