It is possible that the variance could appear <br />unfair if this variance were granted and those 10 other properties which did not <br />have the space for an 18-foot deep deck were denied similar requests to have 18- <br />foot deep decks which required variances from the rear setback requirement. <br />Those properties would need to demonstrate that the deck would have minimal <br />impact on the neighborhood (they would likely have to abut Floral Park for this to <br />be true, which would apply to only 7 of the 10 properties) and also why not <br />having the 18-foot deep deck is a hardship. On most of these properties a deck of <br />18-feet deep could be built, attached to certain points of the rear of the principal <br />structure, without entering the rear setback area. This leaves approximately 3 <br />properties with situations similar to that of the applicant. In light of these <br />circwnstances, staff is of the belief that granting the variance would not alter the <br />essential character of the neighborhood. <br /> <br />Deadline for Al!enev Actions <br /> <br />The City of Arden Hills received the completed application for this request on June 6, <br />2003. Pursuant to Minnesota State Statue, the city must act on this request by August 7, <br />2003 (60 days), unless the City provides the petitioner with written reasons for an <br />additional 60 day review period. The city may with the petitioner's consent extend the <br />review period beyond the 120 days. <br /> <br />Options <br /> <br />1. Recommend approval as submitted. <br />2. Recommend approval with conditions. <br />3. Recommend denial. If the City denies the petitioner's request, "... it must <br />state in writing the reasons for the deuial at the time that it denies the request". <br />4.
