Would grauting the variance be in keeping with the spirit and intent of the <br />City's Zoning Ordinance? <br /> <br />Yes, Currently the Zoning Ordinance allows principal structures to be set back as <br />close as five feet from interior side yards. If the garage were attached to the <br />building it could be constructed five feet from the interior side property line. The <br />interior side setback requirement appears to be an oversight in the Zoning <br />Ordinance which should be addressed by the next revision of the Zoning <br />Ordinance. Therefore it appears that granting the variance would be consistent <br />with the spirit and intent of the Zoning Ordinance. <br /> <br />Could the property in question be put to a reasonable use without the <br />granting of the variance? <br /> <br />!y!!:. If the variance were not granted the applicant would not have a reasonable <br />location for a garage. The applicant cannot move the garage further to the rear on <br />the lot, making the garage comply with the side yard setback requirement and still <br />leaving a reasonable access angle to the garage, without removing a huge <br />Cottonwood tree. The new garage is a slightly larger single-car garage (16 x 22) <br />than the original single-car garage (12 x 20). Since the original garage was <br />already five feet from the property line, even a garage exactly the same in size as <br />the original garage could not be built in the same location without receiving a <br />variance. <br /> <br />Was the hardship created by the owner? <br /> <br />!y!!:. The house and garage were constructed in 1941 by a previous owner. The <br />construction actually precedes the first Arden Hills Zoning Ordinance. The <br />applicant did not play any part in the platting of the lot, the layout of her property <br />or any other site considerations which have caused the hardship. The original <br />garage was recently removed due to its poor structural condition. Staffbelieves <br />that the hardship was not created by the owner. <br /> <br />Would granting the variance alter the essential character of the <br />neighborhood? <br /> <br />No. The effect of the garage should not alter the character of this neighborhood. <br />The Zoning Ordinance allows principal buildings and attached garages to be <br />constructed at the distance the applicant is requesting. Furthennore, many <br />detached garages in the vicinity of this property are currently 5 feet away from the <br />side property line (see applicant's photographs for examples). <br /> <br />PC #03-17 - PC Report 0710912003 - Page 4 of5 <br />
