<br />- <br />, " <br /> <br />. ) <br /> <br />() <br /> <br />Variance Findinl!s <br /> <br />. <br /> <br />Minnesota State Stature 462.357, subd. 6, requires that Cities consider the following five <br />matters when hearing requests for zouing ordinance variances. <br /> <br />1. Are the circumstances for which the variance is requested unique to the <br />property? <br /> <br />Yes, Over time the shoreline has eroded, especially at the southwest comer of the <br />property and decreased the amount of developable property between the house <br />and the Ordinary High Water Mark. Had the shoreline not eroded to the degree <br />that it has (see the 1974 and 2003 surveys) the applicant may have been able to <br />add to the rear of the house without a variance. Currently, there is approximately <br />7.8 feet of developable space at the southwest comer of the house. However, this <br />is not enough space to make an appropriate addition. Furthermore, the applicant's <br />health conditions have prompted the applicant to consolidate activities on the <br />main level of the house. Consolidating these activities would likely require more <br />space on the main level of the house. <br /> <br />2, <br /> <br />Would granting the variance be in keeping with tbe spirit and intent of tbe <br />City's Zoning Ordinance? <br /> <br />. <br /> <br />The stated Purpose and Intent of the City's Zoning Ordinance include the <br />following applicable statements: <br /> <br />Yes. <br />This ordinance is enacted for the following purposes: <br />· To promote the character of and preserve and enhance the properties and <br />areas within the City including wetlands, ponds, and marshes. (Section <br />1,8,2) <br />· To fix reasonable standards to which buildings, structures and land shall <br />conform for the benefit of a11.(Section 1,8,7) <br /> <br />The stated purpose of the R-I Single Family Residential District is as follows <br />(Section 5,D,I): <br />L To establish areas for the development of single family detached housing <br />at a maximum density of approximately 3 units per acre. <br />2. To reserve development areas for single-family housing. <br />3. To restrict encroachment of incompatible uses. <br />4. To maintain density limitations. <br />5.
