, r 6!3!03-Release,wpd RELEASE OF EASEMENT WHEREAS, Josephine East, LLC, a Minnesota limited liability company, executed a Declaration of Private Driveway Easement on August 23, 1999 creating a non-exclusive private road easement for driveway, ingress and egress purposes for vehicular and pedestrian traffic over and across real property described as all of Lots 1 and 2, Block 1, Josephine East LLC (the ~Easement Lots") for the mutual benefit of Lots 1 and 2, Block 2, Josephine East LLC (the ~Benefitted Lots"), which was recorded October 21, 1999 in the office of the Ramsey County Recorder as Document No. 3279456; and ~, the City of Arden Hills consented to the terms and provisions of said Declaration of Private Driveway Easement; and WHEREAS, subsequent to the recording of said Declaration of Private Driveway Easement Lot 2, Block 2, Josephine East, LLC was conveyed to Paul M. Lubratt and Lynda Lubratt; and WHEREAS, subsequent to the recording of said Declaration of Private Driveway Easement Lot 1, Block 2 was conveyed to Walter Francis Bauer, as Trustee of the Walter Francis Bauer Living Trust dated May 23, 1994; and WHEREAS, said Declaration of Private Driveway Easement has expired by its terms and by operation of law, NOW, THEREFORE, the undersigned agree and release said Declaration of Private Driveway Easement as follows: RELEASE given , 2003, by Paul M, Lubratt and Lynda Lubratt, owners of Lot 2, Block 2, Josephine East, LLC and Walter Francis Bauer, as Trustee of the Walter Francis Bauer -1- e . .
