August, 2003 to ATS Representatives <br /> <br />Overview <br /> <br />Enclosed for the Council's review is a request by Chesapeake Companies for an extension of the <br />previously approved Master Plan PUD. Currently, the Zoning Ordinance indicates that a final <br />approval must be obtained within six months, or the master plan approval is void. <br /> <br />As Council will recall Chesapeake requested, and the Council granted, a one year extension last <br />September. At that time, the owners of ATS Steel indicated that the zoning approval was <br />limiting their ability to sell their property. At that time, the City indicated, and presumably the <br />Council would continue to indicate that the City would prefer that Chesapeake acquire the <br />property without City involvement. Further, as has always been the case, if Chesapeake and <br />ATS could not come to mutually agreeable tenns that ATS is free to sell to any willing buyer. <br />Staff sent a letter to A TS Steel representatives informing them of the extension request. <br /> <br />Staff has conferred with the City Attorney, and he indicated that there were no significant legal <br />implications if the extension were to be granted again. You will note that Chesapeake is <br />requesting a 24 month extension. Since our development regulations could change over a 2 year <br />period, staff would suggest a 12 month extension. <br /> <br />Requested Action <br /> <br />1. In Planning Case 01-05 staff recommends approval ofa 12 month extension for submitting a <br />Final Plan PUD. <br />
