We believe it would be beneficial <br />if we had an opportunity to meet with Peggy McKee to explain our interest in acquiring her <br />property. <br /> <br />We have accepted ATS's attorney's direction not to communicate at all with the McKee's (letter <br />dated April 10, 2002 from Mr. Dan Beeson) and made all of our recent effort to communicate <br />through you (ATS's broker). However, we still think that a personal meeting will give a better <br />chance of working out a deal that is mutually agreeable, <br /> <br />We expressed to you on a number of occasions our willingness to meet and hope that you would <br />try again to facilitate a meeting with Ms, McKee. <br /> <br />We hope to clarify and discuss several issues, You mentioned she was upset last year regarding <br />the approval of the master PUD for the redevelopment of the area comprising our two properties. <br /> <br />The PUD does not in any way change the current legal status of ATS's property. ATS is located <br />in the Gateway Business DistTict which established the guidelines and policies for the <br />redevelopment of all the properties within the District. The City of Arden Hills ("City.') <br />established the District to redevelop the properties and that zoning change is what placed the <br />ATS property into a "non-conforming" use. The City created the Gateway Business District in <br />approximately 1989 and was in place long before CMK Arden Holdings even acquired the <br />adjacent property (December 200 I), <br /> <br />The zoning and legal status of A TS does not change whetheT the PUD is in place or not. <br /> <br />The purpose of the PUD is for the City to establish the redevelopment guidelines/standards that <br />the City would allow as acceptable building parameters for a new development. <br /> <br />The PUD does not change the legal status of A TS under the Gateway Business District. <br /> <br />11100 w....yz:..r,., BOI L.l-X"RO.
