September 3, 2003 Letter from Kraus-Anderson to Guidant
2. HCM Original Design
3. RSP Currently Approved Design

. Overview

Recently, the Council approved the desigu of the Cummings Park Shelter. As Council will
recall, as part of the development agreement between Guidant and the City, Guidant is required
to construct a shelter in an amount not to exceed $350,000. After finalizing the cost estimates
for the shelter as currently designed, the cost is currently estimated at $450,000. Enclosed is a
letter from Kraus-Anderson to Guidant providing a breakout of the costs. In a meeting with
Kraus-Anderson and Guidant, they indicated that they received bids from other contractors as
well all yielding approximately the same cost. There are generally two options to address the
cost differential. These options include:

1. Allocating approximately $100,000 from the Park Fund to cover the difference
2. Go back to the original park shelter design prepared by HCM thereby reducing the
project budget to $350,000.

From staffs perspective, the second option is preferable. While there are only minor changes in
the facility as currently approved and the original desigu, the Council will note the following:

.

)> The currently approved building plan calls for an L shaped building while the original
plan called for a rectangular building. In our discussions with RSP, we indicated that we
wanted a building like the one currently in Tony Schmitt Park. We intended that to
primarily pertain primarily to building materials. They took the currently approved
design one step further by replicating the layout of the Tony Schmitt building.
)> The currently approved building plan has a roof over the entire picnic area while the
original plan only partially covers the picnic area. The remainder of the picnic area is an
open air courtyard enclosed by a half wall.
