The drainage improvements required the dedication <br />of a permanent drainage easement over a part of the association's property. The association <br />property included an existing easement for a city watermain which runs between Fernwood <br />Court and Ingerson Court. <br /> <br />Reason for Vacation of Existing Watermain Easement <br />The existing watermain through the association's property is not located within the existing <br />easement for the watermain. As a part of the drafting of the new drainage easement for the <br />improvements included within the association property, the City Engineer recommended <br />revising the description of the new easement to include drainage and utility improvements <br />(therefore including watermain facilities) and to encompass the actual location ofthe watermain. <br />This approach was discussed and agreed to by Ms. Linda Swanson representing the Josephine <br />Hills Lake Association. The existing watermain easement is therefore recommended to be <br />vacated by the city. As a part of the vacation process, the City is required to conduct a public <br />hearing on the matter. <br /> <br />Public Hearing <br />The City Engineer will give a short overview and description of the easement to be vacated and <br />the easement to be dedicated. The City Attorney will answer any questions involving legal <br />issues and public process related to the vacation of the easement. Attached are exhibits to assist <br />the council with understanding the area to be vacated and the new easement dedication area. <br />
