Are the circumstances for which the variance is requested unique to the
property?

Yes. A limited number of properties which are located on Lake Lane in Arden
Hills that could claim a similar hardship due to the configuration of the parcel.
The applicant also has a very shallow lot (74.2 feet wide) which limits the
applicant's ability to make any improvements to the principal structure without
.. .
rcqutrtng a vanance.

2. Would granting the variance be in keeping with the spirit and intent of the
City's Zoning Ordinance?

The stated Purpose and Intent of the City's Zoning Ordinance include the
following applicable statements:

This ordinance is enacted for the following purposes:
. To promote the character of and preserve and enhance the properties and
areas within the City including wetlands, ponds, and marshes. (Section
I,B,2)
. To fix reasonable standards to which buildings, structures and land shall
conform for the benefit of all.(Section I,B,7)

.

The stated purpose of the R-2 Single and Two Family Residential District is as
follows (Section 5,D,2):
I. To establish areas for the development of single and two family housing at
a maximum density of approximately five units per net acre.
2. To reserve development areas for single and two family housing,
3. To restrict cncroachment of incompatible uses.
4. To maintain density limitations.
5. To take advantage of municipal utilities.
6. To preserve open space.

Yes. The variance requested appears to comply with the stated Purpose and Intent
of the City's Zoning Ordinance and of the purpose of the R-2: Single and Two
Family Residential District. Due to thc extremcly shallow lot, the applicant could
not make the proposed improvements without requiring a variance.

.

N:\Planning Cases\2004\04-05 Spencer Variance (PENDlNG)\03-03-04 PC Report-doc

Page 4 of6
