<br />) <br /> <br />" <br />) <br /> <br />Variance Findinl!s <br /> <br />. <br /> <br />Minnesota State Stature 462.357, subd. 6, requires that Cities consider the following five <br />matters when hearing requests for zoning ordinance variances. <br /> <br />1. Are the circumstances for which the variance is requested unique to the <br />property? <br /> <br />Yes. A limited number of properties which are located on Lake Lane in Arden <br />Hills that could claim a similar hardship due to the configuration of the parcel. <br />The applicant also has a very shallow lot (74.2 feet wide) which limits the <br />applicant's ability to make any improvements to the principal structure without <br />.. . <br />rcqutrtng a vanance. <br /> <br />2. Would granting the variance be in keeping with the spirit and intent of the <br />City's Zoning Ordinance? <br /> <br />The stated Purpose and Intent of the City's Zoning Ordinance include the <br />following applicable statements: <br /> <br />This ordinance is enacted for the following purposes: <br />. To promote the character of and preserve and enhance the properties and <br />areas within the City including wetlands, ponds, and marshes. (Section <br />I,B,2) <br />. To fix reasonable standards to which buildings, structures and land shall <br />conform for the benefit of all.(Section I,B,7) <br /> <br />. <br /> <br />The stated purpose of the R-2 Single and Two Family Residential District is as <br />follows (Section 5,D,2): <br />I. To establish areas for the development of single and two family housing at <br />a maximum density of approximately five units per net acre. <br />2. To reserve development areas for single and two family housing, <br />3. To restrict cncroachment of incompatible uses. <br />4. To maintain density limitations. <br />5. To take advantage of municipal utilities. <br />6. To preserve open space. <br /> <br />Yes. The variance requested appears to comply with the stated Purpose and Intent <br />of the City's Zoning Ordinance and of the purpose of the R-2: Single and Two <br />Family Residential District.
