Roberts Development Company, a Minnesota corporation ("Roberts") is <br />the record fee owner of the following described property situated in the <br />City of Arden Hills: <br /> <br />All that part of the East 'h of the Southeast y., of Section 27, <br />Township 30, Range 23 West, described as follows: <br /> <br />Commencing at the East Quarter of said Section 27, thence <br />southerly along the East line of said Section 27, a distance <br />of 373,0 feet to the point of beginning; thence West at right <br />angles 525,6 feet; thence South at right angles 424.1 feet; <br />thence East at right angles 525,6 feet; thence North at right <br />angles 424,1 feet along the East line of said Section 27 to <br />the point of beginning, Subject to easement for parking and <br />driveway purposes over the Northerly 50 feet thereof, and <br />subject to Lexington Avenue and subject to a drainage <br />easement over the West 67 of the East 100 feet thereof (the <br />"Property"), <br /> <br />. <br /> <br />B, The Property is located in a B-3 Zoning District (Retail Center). A <br />motorized vehicle service use is allowed by special use permit in a B-3 <br />Zoning District. <br /> <br />C, Roberts has leased a portion of the Property ("Leased Premises") to <br />Clutch & U-Joint of Brooklyn Park, d/b/a Proven Force (the "Permittee"). <br /> <br />D, The Leased Premises is illustrated on a site plan which has been signed <br />by the Arden Hills City Planner, and is included as part of Arden Hills case <br />number 04-08, <br /> <br />E. On the 5th day of March, 2004, Permittee submitted a completed <br />application requesting a special use permit for a motorized vehicle service <br />use on the Leased Premises (the "SUP"), <br /> <br />F, <br /> <br />On the ih day of April, 2004 at the conclusion of a public hearing, the <br />Arden Hills Planning Commission recommended approval of the SUP, <br /> <br />. <br />
