<br />. <br /> <br />. <br /> <br />. <br /> <br />8. <br /> <br />9, <br /> <br />, <br />'j <br /> <br />7.2 The Contractor shall provide scale receipts of the recyclable materials <br />collected. <br /> <br />[nsuraoce <br /> <br />8.1 Prior to commencement of this Agreement, the Contractor shall furnish <br />the City with certificates of insurance for comprehensive general liability , <br />automobile liability and property damage insurance, to meet all City <br />insurance requirements. The policy shall require the lnsurance Company <br />to notiJY the City in writing of any cancellation in coverage, at least ten <br />(10) days prior to cancellation. Any losses to persons or property through <br />this project shall be the responsibility of the Contractor. The Contractor <br />agrees to indemnifY thc City from any and all liability or loss arising in <br />any way out ofthe performance of this contract. <br /> <br />Relationship of Parties <br /> <br />9.1 The parties intend that an independent Contractor-employee relationship <br />will be created by the contract, The City is interested only in the results to <br />be achieved, and the conduct and control of the City for any purpose, and <br />the emptoyees of the Contractor are not entitled to any of the benefits that <br />the City provides for its employees, <br /> <br />10. <br /> <br />Termination/Extension <br /> <br />10.1 u: in the City's opinion, the Contractor fails to carry out the services <br />diligently and on schedule, and in a quality manner, the City shall have the <br />right to terminate the agreement. Prior to termination, the City will give <br />written notice of intent to terminate, This intent to terminate shall be served <br />upon the Contractor thirty (30) days prior to termination. <br /> <br />10.2 If, at any time during the term of this contract significant changes to the <br />program occur (i.e,: use of recycling bins, frequency of pick up, addition of <br />new collectible materials, etc...), the City and the Contractor mutually agrec <br />that the contract will open for negotiation and! or unless negotiated <br />differently, will terminate at the end of that calendar year. <br /> <br />10,) If, at the end of the term of this contract, the City and the Contractor <br />mutually agree on an extension of this contract, this agreement will remain in <br />effect until otherwise renegotiated. <br />
