.

.

.

~
~~HILLS

MEMORANDUM

DATE: June 12,2004

TO: City Council
Michelle Wolfe, City Administrator

FROM: Scott Clark, Director of Community DevelopmenQ

SUBJECT: City Council! Development Work Session 6/14/04

Staff is proposing the following discussion points for the City Council! Development Team
Work Session on June 14,2004. The items identified for this work session were agreed upon at
the last Development Team Meeting (June 1, 2004),

I) Environmental Insurance- Council has had questions in the past regarding how
environmental liability insurance works, coverage, length of policies, etc. Linda
Belke-Picha, an insurance broker who works with the Marsh Companies, will be
present for questions. It is anticipated that she will make a short, general presentation
discussing this type of insurance and then stand for questions. Staff anticipates this is
the first in a potential series of discussions regarding this particular issue.

2) Questions and Answers- At the May 10, 2004 Council Meeting, the CRR
development group answered the majority of questions that had been compiled by the
Council. There are still a few open questions to be answered and Councilor CRR
may have some additional questions and clarifications. Attached is a draft copy ofthe
responses from the aforementioned meeting.

3) The main discussion at the previous June I, 2004 Devclopment Team Meeting was
review of a proposed amended Interim Devclopment Agreement. Jerry Filla, City
Attorney, gave a presentation regarding potential changes from the original
agreement (which terminates in November of this year) to the proposed. The major
items include: 1) Extension of time until August 31, 2005 to complete the required
actions, It was discussed that this date may be to aggressive and further discussions
would be needed to establish a more realistic date. 2) Amendment of escrow budget.
3) Willingness of CRR to expend additional costs for site characterization studies that
perhaps should be Army responsibility. 4) Moving the status of CRR to Master
Developer (Section 4.D) pursuant to conditions outlined in the Agreement. Direction
on how to proceed and direction on the contents of a new Interim Agreement is
pivotal since the old Agreement will be terminating in November.

\\Earth\Planning\Misc Filcs\TCAAP\Developrnent Team\06-14-04 Council Meeting Insurance Memo.doc
