<br />, <br /> <br />. <br /> <br />e <br /> <br />Casualty Company of Wisconsin, and/or Rochon Corporation, from any and all <br /> <br />claims, disputes, allegations, rights, causes of action and all damages, past, present <br /> <br />or future, whether known or unknown, relating to the services provided by Pete's to <br /> <br />the City for work performed at Highway 96 and Hamline Avenue by Collins Electric. <br /> <br />The City further fully agrees to completely and forever remise, release, acquit and <br /> <br />discharge Pete's, General Casualty and/or Rochon from any and all claims, rights, <br /> <br />causes of action, and all damages, past or present, known or unknown, that may be <br /> <br />covered or arguably covered under General Casualty Company of Wisconsin policy <br /> <br />number CCJ0296697, issued to Pete's. <br /> <br />3. It is the parties' intent that this Settlement Agreement and Partial Release be <br /> <br />construed in accordance with the principles set forth in Meadowbrook, Inc. v. Tower <br /> <br /> <br />Insurance Company, Inc., 559 N,W.2d 411, 416 (Minn. 1997), Accordingly, it is <br /> <br /> <br />understood between the parties that the seope of the Settlement Agreement and <br /> <br /> <br />Partial Release is limited to the resolution and dismissal of claims that may be made <br /> <br />against Rochon that arguably are covered under the General Casualty policy of <br /> <br />Pete's, only. Such claims would include those claims relating to damage to other <br /> <br />property, including but not limited to, claims which were necessary after traffic <br /> <br />signal loops at Highway 96 and Hamline Avenue in the City of Arden Hills were <br /> <br />allegedly damaged because ofthe installation of water and sewer utilities for the new <br /> <br />City HaiL Claims related to other work alleged to have been performed by Rochon, <br /> <br />for which damages are claimed by the City, that have been presented in the <br /> <br />e <br /> <br />. <br /> <br />3 <br />
