<br />. <br /> <br />~ <br />~~HILLS <br /> <br />MEMORANDUM <br /> <br />DATE: <br /> <br />September 12, 2005 <br /> <br />Agenda Item <br /> <br />6.B <br /> <br />TO: <br /> <br />Mayor and City Council <br /> <br />Peter Hellegers, City Planner .~ <br /> <br />FROM: <br /> <br />SUBJECT: Planning Case #01-05, Chesapeake Companies <br />NE Quadrant ofI-694 and 1-35W <br />Extension for Mastcr Plan POD - NE Quadrant/Interstate Crossing <br /> <br />Requested Action <br /> <br />Consider thc applicants' request for a one-year extension for their Master Plan POD. <br /> <br />(The Zoning Ordinance slates that "within six months after obtaining Master Plan <br />approval, or within such extended period of time as the council has agreed to" [Sec. <br />5N6a], the applicant shall submit a Final Plan PUD). <br /> <br />. Backl?:round <br /> <br />At their meeting on March 26, 2001 the Arden Hills City Council approvcd a Master Plan PUD <br />for Chesapeakc Companies subject to 13 conditions. Condition 13 states that "Due to thc time <br />requirements of land acquisition and securing major tenants, the time requirement for the final <br />plan to be submitted no more than six months after the datc of City Council's approval of the <br />Master PUD be changed to eightccn months for this proposal." It is clear that the Council at that <br />timc recognized that this project would not bc ready for development within the standard POD <br />framework. Subsequent to this approval thc office market fell to its lowest level in ycars and has <br />not since fully reboundcd. Chesapeake has come back to thc Council on three times now for <br />extensions to their PUD. Last fall thc City Council revicwed Chesapeake's request for an <br />extension and addcd new condition number 14, which would reserve the City's right to require <br />an updated traffic study or EA Wand would also require Chesapeake to comply with new <br />development regulations of substantial changes to the City's development regulations are made. <br /> <br />Acquisition of the propcrties within the project area was a stumbhng block for this development <br />for quite some time but these issues have now been resolvcd. Chesapeake acquired the ATS <br />Stcel property in March of this year.
