<br />~ <br />~HILLS <br /> <br />MEMORANDUM <br /> <br />. <br /> <br />DATE: <br /> <br />February 28, 2005 <br /> <br />Agenda Item 6.D <br /> <br />TO: Mayor and City Conncil <br />FROM: Peter Hellegers, City Planner ft. <br /> <br />SUBJECT: PC #05-02, Debra and William Thornton <br />3510 Siems Court <br />Variance <br /> <br />Requested Action <br /> <br />The applicant has requested an ll-foot front yard setback for an addition to the front of the <br />applicant's property in Arden Hills. <br /> <br />Planninl! Commission Findinl!s and Recommendation <br /> <br />Findings . <br />At their February 2, 2005 meeting the Planning Commission held a public hearing for Planning <br />Case #05-02 and after the conclusion ofthe public hearing and review of the case, made the <br />following findings: <br />1. There are the circumstances for which the variance is requested that are unique to the <br />property. <br />2. Granting the variance would be in keeping with the spirit and intent ofthe City's Zoning <br />Ordinance. <br />3. The property in question could not be put to a reasonable use without the granting ofthe <br />vanance. <br />4. The hardship was not created by the owner. <br />5. Granting the variance would not alter the essential character of the neighborhood. <br /> <br />Recommendation and Conditions of Approval <br />After making the findings listed above, the Planning Commission unanimously recommended <br />approval (6-0) for an 1 I-foot Front Yard setback variance which would allow for the <br />construction of a new addition to the western side of the applicant's house subject to the <br />following condition: <br /> <br />1. The applicant shall file all necessary building permits with the Building Official for <br />approval prior to the issuance of a building permit.
