CONSENT CALENDAR <br /> <br />a. Claims and Payroll <br />b. Resolution No. 05-21: Appointing Roberta Thompson to the Planning Commission <br />c. 2004 PMP-Edgewater Neighborhood - Partial Payment to Amt Construction <br />d. Resolution No. 05-22: Appointing David McClung, Derrek Hames, Lanny Baumann, <br />and Roger Williams to the Parks, Trails, and Recreation Committee <br /> <br />MOTION: Councilmember Grant moved and Councilmember Larson seconded a <br />motion to approve the Consent Calendar and to authorize execution of all <br />necessary documents contained therein. The motion carried unanimously <br />(5-0). <br /> <br />4. Holidav Stationstores Purchase Al!l"eement Resolution No. 05-23: Waivinl! Planninl! <br />Commission Review of Disposal of Real Property and Authorizinl! Execution of <br />Purchase Al!reement <br /> <br />Mr. Clark stated as discussed at the January 24, 2005 Council Work Session, Holiday <br />Stationstores had submitted a purchase agreement to the City to purchase the Indykiewicz <br />property. City Attorney Filla and staff had met with Holiday Stationstores and made a few minor <br />revisions. The City Attorney was now satisfied with the legal terms of the Agreement. Key <br />points included: A purchase price of $800,000; a closing on or before September 30, 2005; a <br />Purchase Agreement contingent on City approvals for site plans, building permits and other land <br />use requirements; and a right of repurchase clause stating that if Holiday Stationstores does not <br />begin construction by December 31, 2005 the City has the right to repurchase based on the <br />conditions given. <br /> <br />Councilmember Larson asked if Holiday Stationstores was aware of the fact that the City had a <br />very high expectation for this station and they did not want it to look like the other Holiday . <br />Stationstores. Mr. Clark replied this has been communicated to them. <br />
