<br />. <br /> <br />. <br /> <br />. <br /> <br />~ <br />/]'\~ HILLS <br /> <br />MEMORANDUM <br /> <br />DATE: <br /> <br />Work Session Item #2,E <br /> <br />April 18, 2005 <br /> <br />TO: <br /> <br />City Council <br />Scott Clark, Director of Community Development Q; <br /> <br />FROM: <br /> <br />SUBJECT: TCAAP Interim Agreement <br /> <br />As the Council may be aware of, the next step in the TCAAP process needs to be the adoption of <br />a new Interim Agreement, since the existing Agreement terminates on May 9, 2005. The <br />purpose of a new Agreement will be to: 1) Serve as a bridge from now until the time a final <br />Master Development Agreement is negotiated and finalized; and, 2) Define the functions and <br />tasks that need to be completed to effectuate the early transfer process. <br /> <br />The following is a summary of the various sections that a new Agreement would contain. At the <br />Council's Work Session staff would like to discuss issues associated with the Agreement and to <br />develop a time line as to when consideration of this action could be placed on a future agenda. <br /> <br />Recital of Goal <br />This section would detail the goal of arriving at a Master Development Agreement and <br />attempting to have a transfer in the first quarter of 2006. The timeline would be written in a <br />fashion so that if a transfer did not happen by March of 2006 some level of extension could be <br />accomplished without having to redo a new Agreement. <br /> <br />Recital of Work Completed to Date <br />This would be a declarative statement listing work accomplished to date as part of the past <br />Agreements, e.g., TCAAP Framework Vision, Financial Participation Plan, Phase III Planning, <br />and the negotiations to date with the GSA. <br /> <br />Chan!!e in Status Desi!!nation of Development Team <br />Full description of CRR, LLC, as Master Developer and the circumstances that would trigger <br />that event. <br /> <br />Updated Bud!!et <br />This section would: 1) Establish a new budget (costs that the developer would reimburse the <br />City); and, 2) Establish the conditions whereby the City would have to reimburse the developer. <br />
