In making theSe findings, the Council shall consider the natnre of the <br /> <br />proposed nse ofland and the existing use ofland in the vicinity, the number of persons <br /> <br />to reside or work in the proposed subdivision and the probable effect of the proposed <br /> <br />sUbdivision upon traffic cOnditions in the vicinity. In granting a variance as provided <br /> <br />in this section, the Council shaIl prescribe only such conditions that it deems desirable <br /> <br />or necessary to the public interest. <br /> <br />1150.02 Applications. Application for any variance shall be in writing by the subdivider at the <br /> <br />time when the preliminary plat is filed for the consideration of the City Council, stating fully <br /> <br />and clearly all facts relied up'on by the petitioner, and shaIl be supplemented with maps, plans . <br /> <br />or other additional data which may aid the Council in the analysis of the proposed project. <br /> <br />The plans for the development shall include the covenants, restrictions or other legal <br /> <br />provisions necessary to guarantee the fuIl achievement of the plan. <br /> <br />1150.03 Minor SUbdivisions of Unplatted Property. <br /> <br />Subd. 1. General. In the case of a proposed subdivision of an unplatted tract of land, <br /> <br />which subdivision is smaIl in size and of minor importance and which tract is located in <br /> <br />an area where conditions are weIl-defined, the City Council, upon review and after <br /> <br />report of the planning commission, may exempt the subdivider from compliance with <br /> <br />some ofthe provisions of this chapter.
