<br />. <br /> <br />. <br /> <br />~ <br />~~HILLS <br /> <br />MEMORANDUM <br /> <br />DATE: <br /> <br />Agenda Item 6.C. <br /> <br />May 25, 2005 <br /> <br />TO: <br /> <br />Honorable Mayor and City Council Members <br />Michelle Wolfe, City Administrator <br /> <br />Schawn Johnson, Assistant to the City Administrator~ <br /> <br />FROM: <br /> <br />SUBJECT: <br /> <br />Proposed Peddlers, Solicitors, and Transient Merchants Ordinance #360 <br />-Revising Section 340 of the City Code <br /> <br />Backe:round <br />In 2004, City staff received a number of inquires from peddlers, solicitors, transient merchants, <br />and political organizations regarding the process and procedures involved in the distribution of <br />goods, services, and political literature to the residents of Arden Hills. After reviewing the <br />City's current ordinance, it was determined by the City Attorney and staff that the creation of a <br />new ordinance may be more advantageous to the City. The existing ordinance can be very <br />difficult to interpret and some of the information that is being regulated is outdated or no longer <br />applicable, The proposed ordinance more clearly defines the application process and the City's <br />regulations regarding the sclling or distribution of goods, services, advertisement, and political <br />literature, City staff is also attempting to minimize confusion by clearly defining what <br />organizations are exempt from the permitting process. The following groups or organizations are <br />considered exempt from Section 340,03 of the permitting process stated in this ordinance: <br />I. Bona fide residents of the state selling farm and/or garden produce cultivated by <br />themselves, provided that such sales can be conducted without creating traffic hazards; <br />2. Children age eighteen or younger, soliciting for school sponsored activities; <br />3. Garage sales, flea markets and estate sales; <br />4. Thc acts of merchants or their employees in delivering goods in the regular course of <br />business; <br />5. Solicitations by organizations for philanthropic religious, political, charitable, non-profit <br />or educational causes, <br />Although these groups are considered exempt from the permitting process, the City will still <br />require that these activities be registered on an application form, provided by the City, ten days <br />prior to the event. <br /> <br />Recommendation <br />City staff is requesting City Council approval of the Peddlers, Solicitors, and Transient Merchant <br />Ordinance #360, <br /> <br />.
