<br />. <br /> <br />. <br /> <br />. <br /> <br />STATE OF MINNESOTA <br />COUNTY OF RAMSEY <br />CITY OF ARDEN HILLS <br /> <br />PLANNED UNIT DEVELOPMENT/SPECIAL USE PERMIT <br />CASE NO. 05-13 <br /> <br />1.0 RECITALS. <br /> <br />A. Holiday Station Store, Inc. ("Permitee") represents that as of the date of <br />the recording of this Planned Unit Development/Special Use Permit (the <br />"PUD/SUP"), it will be the record fee owner of the following described <br />property situated in Ramsey County, Minnesota: <br /> <br />Lot 1, Block 1, Holiday Lake Addition (the "Property") <br /> <br />B. The Property is located in the NB (Neighborhood Business) District. A gas <br />station/convenience store/car wash is allowed in the NB zoning district <br />by special use permit. <br /> <br />c. <br /> <br />On the 1st day of May, 2005, Permitee submitted a completed application <br />to the Arden Hills City Planner requesting approval of a special use <br />permit which would allow Permitee to use the Property as a gas <br />station/convenience store/carwash (the "Application"). <br /> <br />D. At a public hearing on the 6th day of June, 2005, the Arden Hills Planning <br />Commission reviewed the Application; the report and recommendations <br />of the Arden Hills City Planner; the comments made at the public <br />hearing; and recommended approval of the PUD/SUP subject to certain <br />conditions. <br /> <br />2.0 APPROVAL OF PUD/SUP. On the 27th day of June, 2005, the Arden Hills City <br />Council considered the recommendations of the Arden Hills City Planner; the <br />recommendations of the Planning Commission; the effects of the proposed <br />PUD/SUP on the health, safety, convenience and general welfare of the owners <br />and occupants of the surrounding land, and the community as a whole; and <br />adopted Resolution No. 05-42 approving the PUD/SUP and Final Plat and <br />allowing the Property to be used for a gas station/convenience store/carwash. <br />The approval of the Arden Hills City Council was effective upon the recording of <br />the Holiday Lake Addition Plat; the recording of the conveyance of Lot 1, Block <br />1, Holiday Lake Addition to Permitee; and was subject to the following <br />conditions: <br /> <br />A. <br /> <br />Permitee shall submit revised plans which incorporate the Plan Review <br />Comments from the Arden Hills City Planner's report, as contained in <br />
