However, if the variance is approved with the minor subdivision, Staff proposes <br />this alternate set of nine conditions: <br />I. The applicant shall file the minor subdivision with the Ramsey County recorder and <br />shall provide the City with a recorded copy within sixty days of the final approval <br />date. <br />2. The applicant shall file the 21 foot drainage and utility easement with the Ramsey <br />County and shall provide the City with a recorded copy within sixty days of the final <br />approval date. The restrictive easement may be incorporated with the decd for the <br />land or suhmitted as a separate recordable document and is subject to approval by the <br />City Attorney. <br />3. The portion of the existing structure that is designated for removal on the submitted <br />survcy shall be removed before any new building permits are issued for any structures <br />on either lot except for any permits needed to remove the required portion of the <br />existing dwelling. <br />4. Any additions to the existing dwelling on the western lot shall meet all setback <br />requirements. <br />5. Any new structures on the western lot shall not encroach any closer than 21 feet to the <br />western lot line to preserve a total of25 feet of side lot setback as required in the R-I <br />Zone. <br />6. The six pine trees, two oak trees, and one elm tree between the western edge of the <br />existing structure and the western lot line shall not be removed without approval of <br />the City Council (The trees and their locations are identified on the Site Development <br />Plan for 1401 Skiles Lane). If the trecs are determined by thc City to be dead or <br />dying, the trees may be removed and shall be replaced in accordance with the Design <br />Requircment of the Landscape Plan provisions of Appendix A, Procedural Manual, of <br />the City of Arden Hills Zoning Ordinance. <br />7, The applicant shall pay a park dedication fee before filing the subdivision with <br />Ramsey County. The dedication fee shall he determined by the City Council. <br />8. Any extension of City services for the new lot shall be subject to approval by the City <br />Engineer and all associated costs shall he the responsibility of the applicant. <br />9, The applicant shall comply with applicable provisions of the City Code and related <br />ordinances. <br /> <br />Resident Comment <br /> <br />Staff has not received any letters or telephone calls from properly owners or occupants in regard <br />to this planning case.
