The variance allows us to leave the house <br />mostly where it is and save most of the trees on the site. Furthermore, <br />there are a number of houses in the area and particularly on Skiles that <br />are non-conforming, including the two across the street that are on 80' <br />wide lots and two lots to the west, one of which is 75' wide and one of <br />which is 85' wide. Drawing 1 also indicates (though house locations <br />and sizes are not exact) that there are likely a number of houses on <br />Skiles and elsewhere in the neighborhood that do not meet the <br />sideyard setback requirements. <br /> <br />D. Summary <br /> <br />We appreciate the City Council taking the time to consider this matter and recognize that <br />we are asking for a lot in requesting that the Council grant the Minor Subdivision and <br />Variance request. We do so because the variance is the option that offers the best use of <br />the property for us, protects the maximurn number of trees on the lot and preserves the <br />character ofthe neighborhood while meeting every other subdivision ordinance of the <br />city. We anticipate that the request would be granted contingent on the removal ofthe <br />eastern portion of the house. We are ready to apply for a permit and start that work <br />immediately and would it removed within 30 days. <br /> <br />We understand if the Council is not willing to grant us the Minor Subdivision and <br />Variance and in such case request that the Council table the issue and refer it back to the <br />Planning Commission.
