. . . 3.4.10 Contractor(s)! Completion Documents. ENGINEER shall receive and review maintenance and operating instmctions, schedules, guarantees, bonds and certificates of inspectioJl, test and approvals which are to be assembled by Contractor(s) in accordance with the Contract Docnments (but such rcview will only be to detennine that their content complies with the requirements of, and in the case of certificates of inspection, tests and approvals the reslltts certified indicate compliance with, the Contract Documents); and shall transmit them to CITY with \\'Tilten comments. 3.4. t I Inspections. ENGtNEER shall conduct an inspection to detenninc if the work is substantially complete and a final inspection to determine if the completed work is acceptable so that ENGINEER may recommend, in writing, finat payment to Contractor(s) and give written notice to CITY and the Contractor(s) that the work is acceptable (subject to any conditions therein expressed), but any such recorrunendation and notice will be subject to the limitations expressed in paragraph 3.4.10. 3.4.12 As-Built Drawings. Upon completion of the Construction Phase, ENGINEER shall prepare a set of reproducible record prints of Drawings showing those changes made during the construction process, based on the marked-up prints, drawings and other data furnished by Contractor(s) and such records maintained by ENGINEER during the Construction Phase. ENGINEER will not be responsible for any errors or omissions in the information provided by Contractor(s) that is incorporated in the record drawings and record documents. Final payment to ENGINEER will be made only after record drawings are received hy CtTY. 3.4.13 Limitation of Responsibilities. ENGINEER shall not be responsible fix the acts or omissions of any Contractor(s), or of any subcontractor or supplier, or an of the Contractor(s)' or subcontractors' or suppliers' agents or employees of any other persons (except ENGINEER's own employees and agents) at the site or otherwise fUnllshing or pcrfom1ing any of the Contractor(s)' work; however, nothing contained in paragraphs 3.4.1 through 3.4.] I inclusive, shall be constmed to release ENGINEER from liabitity for failure to properly perform duties and responsibilities assumed by ENGINEER in the Contract Documents. 3.5 OPERATIONAL PHASE During the Operational Phase, CITY may authorize ENGJNEER to perform one or more of the following services: 3.5.1 Provide assistance in the closing of any fmancial or related transaction for the Project 3.5.2 Provide assistance in connection with the refming and adjusting of any equipment or system. 3.5.3 Assist CITY in training CJTY's staff to operate and maintain the Project. 3.5.4 Assist CITY in developing systems and procedures for control of the operation and maintenance of and record keeping for the Project. 3.5.5 In company with CITY, visit the Project to observe any apparent defects in the completed work, assist CITY in consultations and discussions with Contractor(s) concerning correction of such defects or deficiencies, and make recommendations as to replacement or correction of defective work. 3.5.6 Assist CITY in preparation of assessment roll for ClTY improvement projects, and attend assessment hearings. 3.6 OTHER ADDITIONAL SERVICES In addition to Surveying, Geotechnical Engineering, and Construction Observation services, ClTY may authorize ENGtNEER to pcrfonn any of the following Additional Services: 3.6.1 Preparation of applications and supporting documents (in addition to those furnished under Basic Services) for private or governmental grants, loans or advances in connection with the Project; preparation or review of envirorunental assessments and impact statements; review and evaluation of the effect on the design requirements ARDEN.
