<br />. <br /> <br />. <br /> <br />. <br /> <br />3.4.10 Contractor(s)! Completion Documents. ENGINEER shall receive and review maintenance and <br />operating instmctions, schedules, guarantees, bonds and certificates of inspectioJl, test and approvals which are to be <br />assembled by Contractor(s) in accordance with the Contract Docnments (but such rcview will only be to detennine <br />that their content complies with the requirements of, and in the case of certificates of inspection, tests and approvals <br />the reslltts certified indicate compliance with, the Contract Documents); and shall transmit them to CITY with <br />\\'Tilten comments. <br /> <br />3.4. t I Inspections. ENGtNEER shall conduct an inspection to detenninc if the work is substantially <br />complete and a final inspection to determine if the completed work is acceptable so that ENGINEER may <br />recommend, in writing, finat payment to Contractor(s) and give written notice to CITY and the Contractor(s) that the <br />work is acceptable (subject to any conditions therein expressed), but any such recorrunendation and notice will be <br />subject to the limitations expressed in paragraph 3.4.10. <br /> <br />3.4.12 As-Built Drawings. Upon completion of the Construction Phase, ENGINEER shall prepare a set <br />of reproducible record prints of Drawings showing those changes made during the construction process, based on the <br />marked-up prints, drawings and other data furnished by Contractor(s) and such records maintained by ENGINEER <br />during the Construction Phase. ENGINEER will not be responsible for any errors or omissions in the information <br />provided by Contractor(s) that is incorporated in the record drawings and record documents. Final payment to <br />ENGINEER will be made only after record drawings are received hy CtTY. <br /> <br />3.4.13 Limitation of Responsibilities. ENGINEER shall not be responsible fix the acts or omissions of <br />any Contractor(s), or of any subcontractor or supplier, or an of the Contractor(s)' or subcontractors' or suppliers' <br />agents or employees of any other persons (except ENGINEER's own employees and agents) at the site or otherwise <br />fUnllshing or pcrfom1ing any of the Contractor(s)' work; however, nothing contained in paragraphs 3.4.1 through <br />3.4.] I inclusive, shall be constmed to release ENGINEER from liabitity for failure to properly perform duties and <br />responsibilities assumed by ENGINEER in the Contract Documents. <br /> <br />3.5 <br /> <br />OPERATIONAL PHASE <br /> <br />During the Operational Phase, CITY may authorize ENGJNEER to perform one or more of the following services: <br /> <br />3.5.1 Provide assistance in the closing of any fmancial or related transaction for the Project <br /> <br />3.5.2 Provide assistance in connection with the refming and adjusting of any equipment or system. <br /> <br />3.5.3 Assist CITY in training CJTY's staff to operate and maintain the Project. <br /> <br />3.5.4 Assist CITY in developing systems and procedures for control of the operation and maintenance of <br />and record keeping for the Project. <br /> <br />3.5.5 In company with CITY, visit the Project to observe any apparent defects in the completed work, <br />assist CITY in consultations and discussions with Contractor(s) concerning correction of such defects or <br />deficiencies, and make recommendations as to replacement or correction of defective work. <br /> <br />3.5.6 Assist CITY in preparation of assessment roll for ClTY improvement projects, and attend <br />assessment hearings. <br /> <br />3.6 OTHER ADDITIONAL SERVICES <br /> <br />In addition to Surveying, Geotechnical Engineering, and Construction Observation services, ClTY may authorize <br />ENGtNEER to pcrfonn any of the following Additional Services: <br /> <br />3.6.1 Preparation of applications and supporting documents (in addition to those furnished under Basic <br />Services) for private or governmental grants, loans or advances in connection with the Project; preparation or review <br />of envirorunental assessments and impact statements; review and evaluation of the effect on the design requirements <br /> <br />ARDEN.
