<br />. <br /> <br />. <br /> <br />. <br /> <br />6.2.3 For Construction Phase Services ClTY shall pay ENGINEER on the basis often (10) percent of <br />Constroction Cost or other murually agreed upon method as stated in the Work Order. <br /> <br />6.2.4 For Basic Services identified in section 2.5, CITY shall pay ENGINEER a fixed monthty retainer <br />amount of$2,1 80.00, plus reimbursable expenses. <br /> <br />6.3 METHODS OF PAYMENT FOR ADDITIONAL SERVICES OF ENGINEER <br /> <br />For Additional Services City shall pay ENGINEER on the basis of ENGINEER's Hourly Costs, attached hereto as <br />Exhibit E, "BRW's Hourly Costs", plus reimbursable expenses, or as otherwise agreed in the Work Order. <br /> <br />6.4 TIMES OF PAYMENTS <br /> <br />6.4.] ENGINEER shall submit monthly statements for Basic and Additional Services rendered and for <br />Reimbursable Expenses incurred. The statements will be based upon mcthods of payment outlined in Sections 6.2 <br />and 6.3. ClTY shall make prompt monthly payments in response to ENGINEER's monthty statements. <br /> <br />6.4.2 Upon conclusion of each phase of Basic Services, ClTY shall pay such additional amount, if any, <br />as may be necessary to bring total compensation paid on account of such phase to the following percentages of total <br />compensation payable for all phases of Basic Services: <br /> <br />Phase <br /> <br />Percentaee <br /> <br />Srudy and Report <br />Preliminary Design <br />Final Design <br />Bidding or Negotiating <br /> <br />35 <br />30 <br />30 <br />---2. <br />tOO <br /> <br />6.5 OTHER PROVISIONS CONCERNING PAYMENTS <br /> <br />6.5.1 IfClTY fails to make any payment due ENGINEER for services and expenses within thirty (30) <br />days after receipt of ENGINEER's statement therefor, the amounts due ENGINEER will be increased at the rate of <br />one percent (t %) per month from said thirtieth day, and in addition, ENGINEER may, after giving seven (7) days' <br />written notice to CITY, suspend services lmder this Agreement until ENGINEER has been paid in fuU aU amounts <br />due for services, expenses and charges. <br /> <br />6.5.2 In the event of termination by CITY under paragraph 9.1 upon the completion of any phase of <br />Basic Services, progress payments due ENGINEER for services rendered through such phase shall constirute total <br />payment for such services. In the event of such termination by CITY during any phase of the Basic Services, <br />ENGINEER wiU be paid for services acruaUy and necessarily rendered during that phase by ENGINEER's <br />employees and principals directly engaged on the Project, on the basis of ENGINEER's Hourly Costs stated in <br />Exhibit E to the date of termination. <br /> <br />6.5.3 In the event of any such termination, ENGINEER will also be reimbursed for the reasonable <br />charges of independent professional associates and consultants retained by ENGINEER to render such services, and <br />paid for all unpaid Basic and Additional Services, Reimbursabte Expenses. <br /> <br />6,5.4 Records of ENGINEER's Hourly Costs pertinent to ENGINEER's compensation under this <br />Agreement will be kept in accordance with generally accepted aCcOlmting principles.
