,

~

~
EN HILLS

.

MEMORANDUM

DATE:

May 3, 2006

Agenda Item 7.F

TO: Mayor and City Council

FROM: J ames Lehnhoff, City Planner

SUBJECT: Case #03-19 Extension
Carolyn Mohn
3459 Siems Court
Variance Extension

Requested Action

.

The applicant has requested the City Council to consider an additional six month extension to a
variance that was approved on August 25,2003.

Background

On August 25, 2003, the City Council approved a variance to allow a 9-foot encroachment on the
shoreline setback at 3459 Sicms Court. The approval was subject to two conditions. The first
condition required the applicant to obtain all necessary building pennits from the Building
Official prior to the issuance of a building pennit. The second condition required approval from
the Minnesota Department of Natural Resources. The DNR did review the application and did
not have any objections to the proposed plans.

Typically, a variance expires one year from the date of approval if the applicant does not file for
a building pemlit within that period of time. Due to health related issues, Ms. Mohn requested a
one year extension for the variance in August 2004. The City Council approved a one year
extension to the variance on September 13, 2004, that expired in September 2005.

Page 1 of2

.
