<br />PW2006-04 <br /> <br />WHEREAS, the project includes, in addition to other things, installation of trees, shrubs, <br />plants and irrigation. <br /> <br />. <br /> <br />NOW, THEREfORE, IT IS HEREBY MUTUALLY AGREED AS FOLLOWS: <br /> <br />I. The City shall prepare the nccessaxy plans, specifications and proposals. Cost of project <br />revisions after completion of plans and specifications will be paid for by the party <br />requesting the revisions or as dcfined by supplemental agreement. Revisions must be <br />consistent with State Aid requirements and are subject to City approval. <br /> <br />2. The City shall take bid and award a contract for construction of subject project. <br /> <br />3. The County and City shall participate, in principle, on the basis of construction costs and <br />shares identified in accordance with the Bid Tabulation, attached as Exhibit ^ and <br />incorporated herein, except as modified below, It is undcrstood actual costs will be <br />adjusted to reflect final design elements as snbmitted to the City for approval at the time <br />of final plan completion and submission for municipal approval. <br /> <br />4. Upon completion of the project, the City shall own and maintain all landscaping and <br />irrigation located within County road rights-of~way. <br /> <br />5. Any utilities or facilitics modified or added to those provisions presently made in the <br />plans and specifications may be incorporated in the construction contract by <br />supplemental agrecment and shall be paid for as specified in the supplemental agrccmcnt. <br />Dcsign and construction engincering fees for additions shall bc negotiated at the time of <br />supplemental agreement preparation. <br /> <br />. <br /> <br />6. The County shall reimburse the City for cngineering costs incurred on its share of project <br />design and administration, as set forth in Exhibit A, as a preliminary engineering fee. <br />Said fee shall bc 12% of item costs for which the County is responsible for, as <br />dctermined at the time of contract award. <br /> <br />7. The County shall reimburse the City for engineering costs incurred on its share of project <br />construction, as set forth in Exhibit A, as a construction engineering fee. Said fee shall <br />bc 12% of item costs for which the County is responsible for, as dctcrmined upon <br />completion ofthe project. <br /> <br />8. Throughout project dcsign and construction, the City shall prepaxe partial cost and <br />paymcnt estimates for preliminary engineering fees, construction costs, and construction <br />engineering fees and, at appropriate intervals, notify the County of its sharc of thc costs <br />for the County's items of work. County shall pay its share ofcnginccring fees and <br />construction costs within twenty-one calendar days of receipt of City invoicc. <br /> <br />9. The County shall pay to the City all additional remaining costs for its share of the work <br />upon notification by the City of the linal amounts due to the contractor. <br /> <br />. <br /> <br />3 <br />
