<br />TAX BASE REVITALIZA nON ACCOUNT <br /> <br />(a) "Cleanup Costs" or "Costs" mcans: <br /> <br />(I) For hazardous waste or substancc contamination, the cost of implementing a voluntary . <br />response action plan approvcd by the Minnesota Pollution Control Agency under <br />Minnesota Statutcs section 115B.175, subdivision 3. <br /> <br />(2) For asbestos contamination, the cost of implcmenting a projcct-specific asbestos project <br />plan for thc Site and performing asbestos-related work which is carried out by contractors <br />or subcontractors licensed or certificd by the Commissioner of Health under thc Minncsota <br />Asbestos Abatemcnt Act, Minnesota Statutes sections 326.70 to 326.81, in accordance <br />with mles prescribed by the Commissioner of Health rclatcd to asbestos abatement and <br />asbestos management activity, and meeting the federal Asbestos Hazard Emergency <br />Response Act ("AHERA") standards for asbestos. <br /> <br />0) For pctroleum contamination, the cost of implementing a corrcctivc action plan for the Site <br />approved by thc Minnesota Pollution Control Agency under Minnesota Statutes chaptcr 115C. <br /> <br />(4) For lead abatement, the cost of lead abatement work performed by ccrtificd contractors <br />consistent with all applicable fedcral and state laws, mles and standards governing lead <br />abatcment or regulated Icad work on residential or commcrcial properties. <br /> <br />(b) "Council Action" means thc action or decision of thc govcrning body of the Metropolitan <br />Council, on the mceting date identificd at Page 1 of this Agreement, by which the Grantee was <br />award cd Tax Base Revitalization Account grant funds. <br /> <br />. <br /> <br />(c) "Developnlent Authorily" means a statutory or homc rule charter city, a housing and redevelop- <br />ment authority, an economic development autb01ity, or a port authority in thc metropolitan area <br />as defIned by Minnesota Statutes section 473.121, subdivision 2. <br /> <br />(d) "Municipality" means a statutory or home mle charter city or town participating in the Local <br />Housing lnccntives Program undcr lvlinnesota Statutes section 473.254, or a county in the <br />mctropolitan area as dcfincd by Minnesota Statutcs section 473.121, subdivision 2. <br /> <br />(c) "Participating Municipality" means a statutory or home rule chm1er city or town that has elected <br />to participate in thc Local Housing Inccntive Account program and negotiated affordable and <br />life-cyclc housing goals for thc Municipality pursuant to Minncsota Statutes section 473.254. <br /> <br />(f) "Project Cosls" means all costs as defined in Minncsota Statutes scction1 I 6J.552, subdivision 7. <br /> <br />(g) "Site" means the polluted land proposed by the Grantee to be clcancd up and located both <br />within the metropolitan area and within a Participating Municipality. <br /> <br />II. GRANT FUNDS <br /> <br />2.01 Total Grant Amount. The Council will grant to the Grantce the "Grant Amount" identified <br />at Page I of this Agrccment which shall be funds from the Tax Base Revitalization Account of the . <br />Metropolitan Livable Communi tics Fund.
