The <br />varianec is requested because the shoreline width for the 3300 Lake Johanna Blvd. <br />property would decrease from 95 feet to 75 feet, which is less than the minimum 85-foot <br />shoreline width requirement. He reviewed his analysis and reS?mmended approval based <br />on the following conditions: <br /> <br />I. <br /> <br />The applicant shall file the minor subdivisiollcwithR~!"llsey County within sixty <br />days of the approval date or the approval ~han~xpire. <br />The project shall be completed in accordance.with the plarI~ submitted as part of <br />the preliminary plat and variance application. Any significariLchanges to these <br />plans, as determined by the CityPlhnner, shall require review arId approval by <br />the Planning Commission.>;i...i< <br />Any ncw construction on Parcel A or Parc~IB shall conform to all requirements <br />of the R -2 Zone and the ShorcIand Ordinarie-~... <br />The applicant shall obtain any required perrriiisfrom the Rice Creek Watersbed <br />and supply the City with a copy before filing thfW~;.split with Ramsey County. <br />The applicant shall comply with applicable provisions of the City Code and <br />related ordinances. <br /> <br />2. <br /> <br />3. <br /> <br />4. <br /> <br />5. <br /> <br />He indicated staff that an>email dated July 21, 2006 was received from Kim Klawiter, <br />3262 Sandeen Road, who indicated he supported the granting ofthis variance. <br /> <br />Commissioner Larson asked if the house on Lot B was encroaching. Mr. Lehnhoff <br />rcsponded that home had received a variance a few years ago to encroach into the <br />setback. <br /> <br />Chair Sand opened the public hearing at 7: II p.m. <br /> <br />Chair Sand invited anyone for or against the request to come forward and make <br />comment. <br /> <br />TI1ere were no public comments. <br /> <br />Chair Sand closed the public hearing at 7:12 p.m. <br /> <br />Commissioner Bezdieek moved, seconded by Commissioner Thompson, to recommend <br />approval of Planning Case No. 06-02 I, Minor Subdivision and Variance, Bruce and <br />Kathy Haglund, 3300 and 3294 Lake Johanna Boulevard subject to the five conditions as <br />outlined in stair s July 10, 2006 report. <br /> <br />The motion carried unanimously (7-0). <br /> <br />DRAFT <br />
