ARDEN HILLS PLANNING COMMISSION -OCTOBER 4, 2006 3 Commissioner Sand asked if the curb cuts were being put in where the westerly driveway . was located. Me Lis responded they had not bccn put in yet. Chair Sand asked when the home was completed, Me Lis responded it was completed in the fall of 2003, He stated they did the entire driveway at the same time and at the time, they did not know they could not have two curb cuts. Hc stated they did not "sneak" in the second driveway, Commissioner Larson asked when they moved in, was all of the grading done, Me Lis responded everything was done, except the sod had not been put in, Commissioner Zimmerman asked in the plans that were submitted to the City, was it a single or dual access driveway, Me Lis responded a single assess driveway was shown, Commissioner Larson asked if the cmshed rock was on the plans as submitted, Me Lis responded it was. Chair Sand invited anyone for or against the request to come forward and make comment. Bill Thornton, 3510 Siems Court, stated he supported these variances, He noted the neighhorhood was not a "cookie cutter" or new development and it was an eclectic neighborhood, He indicated the housing types, lot shapes, etc. were all different He . noted right across from this gravel driveway was another gravel driveway which had heen there for many years, He statcd there were also other circular driveways with two accesses in the neighborhood, He stated there were also people who had turn around, as well as driveways that were three cars wide, He noted there was no conformity in that neighborhood now because it was not that kind of neighborhood and they did not want it to be that kind of a neighborhood, He believed the crushed stone and the dual access driveway fit into the neighborhood, He stated with respect to the hardship issue, thcy were undergoing major, major constmction - they had lost a lot of trees - and the hardship was for the entire neighborhood, He stated if applicant eould not have a decent size driveway he was coneerned that the two trees would need to be cut down. He noted the two trees could also represent a rain garden for the City. He stated the neighborhood did not want to see those trees go and they would prefer to see a rain garden in this area, Ile believed the City needed to live by some of the uniqueness ofthc neighborhoods. He asked the City to approve both variances. Chair Sand closed the publie hearing at 7:25 p.m, Commissioner Larson asked Building Official Scherbel for the timeline. Mr, Scherbel reviewed the memorandum submitted, He noted there were still some building related issues that remained on this home, He indicated the permit was for a single access drivcway and staff was unsure of the time table for when the current driveway configuration was installed. .
