Michelle Wolfe, City Administrator <br /> <br />~ <br />~~HILLS <br /> <br />CITY OF ARDEN HILLS <br />Ramsey Connty, Minnesota <br /> <br />RESOLUTION No. 06-49 <br /> <br />A Resolution Vacating the City of Ardcn Hills' Interest in <br />A Pedestrian Walkway (Doc # 2257258) on the Section 22 Town 30 Range 23 Plat. <br /> <br />WHEREAS, Royal Oaks Really, lnc, has petitioned the City of Arden Hills to vacate an <br />approximately 20 foot wide and 280 foot long Pedestrian Walkway Easement that is located at 1440- <br />l45D West Highway 96 in the City of Arden Hills; and <br /> <br />WHEREAS, on the 11th day of October, 2006, a public hearing preceded hy published, <br />posted, and mailed notice as required by Minn. StaL ~4l2,85l was conducted before the Arden Hills <br />Council; and <br /> <br />WHEREAS, the pedestrian walkway eascment docs not contain a trdil and no trails are <br />planned tor the pedestrian walkway easement; and, <br /> <br />WHEREAS, Royal Oaks Realty, lnc, has agreed to convey thc trail along the western edge <br />of the property to the City for unobstructed public access; and, <br /> <br />WHEREAS, at the conclusion of the Public Hearing, the Arden Hills Council determined <br />that retention of the pedestrian walkway casement is no longer in the public's interest; <br /> <br />NOW, THEREFORE, BE IT RESOLVED that the Arden Hills Council hereby vacates the <br />City's intcrest in the following dcscribed Pedestrian Walkway Easement: <br /> <br />I. That Pedestrian Walkway Easement tiled under Document #2257258 on the <br />Section 22 Town 3D Range 23 PIaL The legal description of the full property is <br />as tollows: the Northeast Quarter of the Northwest Quarter of Section 22, <br />Township 30, Range 23, Ramsey County, Minnesota, EXCEPT the South y,; <br />thereof and execpt thc east 253,00 feet thereof <br /> <br />AND BE IT FURTHER RESOLVED, that such Pedestrian Walkway Vacation shall be <br />cfTcetive the day following publication in the Shorcview I Ardcn Hills Bulletin. <br /> <br />ADOPTED by the Arden Hills City Council this II th day of October, 2006. <br /> <br />Beverly Aplikowski, Mayor <br /> <br />ATTEST: <br />
