� <br />STATE OF MINI�SOTA <br />COUR"I"t OF F71�' MSEY <br />VILLAGE OF ARDEN HI'i.LS <br />P�E <br />OF PART OF LOT ONE (1 <br />n?. ilCs' i :� ;�fN .. .r(.G�'•.a,_.�Li _ <br />i'.d.'':..��.» ei.,_..�s`-1.1...9_�..T_ <br />i� <br />AUDITOR�S <br />niHEREAS� it is x�ecessary, advisable� and in the public interest that <br />the Village of Arden Hills constxuct, maintain and operate a San3tary <br />Sewer for the purpose of sanitation, and <br />WI�REAS, in order to accomplish such purpose, it is necessary to <br />• <br />acquire the £ollowing described land� namely: <br />A perpetual easement for underground sewer mains� pipes and appurten� <br />ances� and manholes� to an approximate depth of 8 to 11� feet wer <br />and across a strip of land 20 feet in"width� the centerline of which <br />is described as Pollows: <br />Commencing at a point on the souih lix�e o£ that part of Lot 1� <br />Auditorrs 5ubdivision No. 80, lyin� ruithin.the Southeast Quarter <br />(SEq) of tha Southwest puarter (SW4) of Section 33� Township 30� <br />Range 23, said point 6eing, 1237 feet east of tke centerline of <br />New Brighton Road as it now exists; thence Northwesterly appro�cimately <br />190 fe:=t to a point on the Northerly line of said Lot 1� said point <br />being 1179 feet east o£ said centerline o£ said New Brighton Road. <br />A furtner temporary conatruction easement 20 feat in width lying <br />Westerly of and immediately adjacent to the a£oredescribed 20 foot <br />permanent easement. <br />and <br />Wf�REAS, the Council has been unable to purchase said land £rom said <br />�J <br />owners at a price deemed by the Council to be £avorable� and <br />WHEREAS, the 4i11age is advised and believes that the most £easible <br />location for such sanitary sewer is on the land above described, and <br />InTHEREAS, by reason of the inability to purchase said land, it has <br />fiecorae necessary to procure said land by right of eminent domain� <br />NG"rJ THEnEFQRE, BE IT RESOLUED, that the Villa�e of Arden Hills proceed <br />� <br />to procure title to said land under its right of eminent domain and that <br />the 4illage Attorney be instxucted and directed to file the necessary com- <br />nlaint therefor and to prosecute such action to a successful conclusion or <br />until it is abandoned� dismissed� or terminated by the Village or by the <br />Courtg that the Village Attorney� the h.ayor and the Clerk do alI things <br />necessary to be done in the commencement, prosecution, and successful <br />- 1 - <br />
