Carlson <br />vs. Clty of Arden HTlls; referred to pravious tolephone poll of Council <br />members with �eapect to a proposed settlement of this tewsuit which was <br />based on an esttmate that Mr. 8ussard obtained fi�om a contractor, <br />Clemeot Sch�ita, in the amount of approxlmately 31,700.00, vrhtch <br />Mas based, apparently, on a veTbel deseriptton ot the ro�k to be <br />done to rectity the alleged problem. <br />Lynden reported that, since then, tha; Ci.ty Eogineer prepated a <br />brief spec Iist of Ttems to be encomqa5sed by the Installn�Fioq:of the <br />storm serre� pipe; bid.from Clement.ScHmltz, bnsed on the spec Ifst, <br />is E3,9t0.00 <br />Lynden repo�tsd that the four third-party defertdants have been ad- <br />vised tAat the City's position is that it woo't pay anything toward <br />the settlement but wT�i of:fer tha se rvices of the Ctty Engineer'to <br />see that ths settlemerit pfoposed i�s effectuated; noted that he h�ad <br />been told that. the foLf defendants are witling to participate in� the <br />settlement up to b800..each (E3,200.); advised that the trtai ts. <br />set for June �2nd before Judje Archle Gtnga9d. <br />i:: <br />,, <br />Lynden repor'FeE that bccordtng to Mr. Bussa'rd, #hs lti,d irtcrease of <br />52,200.OU 1s beceuse:of catch basins and manholes that the Cfty . <br />Engineer and Rice Creek Watorshed District consider to be necesse�y; <br />according to Engineer Chfistottersen cost of these installa#lons ts <br />estimated at about EI,100. <br />Englneering t{'me xa5 mstlmated at abo�t 4-5 houts. includina sur�eying <br />and stakTng. plus inspecfii,on. <br />. <br />After discussion, Woodbuwn moved, seconded by Wingert, that Cduncil <br />adopt Resolution No. 78-33, Resolution Indemnifying CounN imeh in <br />Connection with fiheir 8eing Named Defendants !n Robert H. Caflsoo : <br />Lawsuit. Motioa-carrled unanimously. <br />Woodburn moved, seconded by Hanson, that Counci) approre the City's <br />willingness to sha�e in up to I/5 of the settlement costs, Including <br />#he expenses of the City Engineer. Motion carried unanimously. <br />Publfc HearinQ - Water Improvement No. 78-2 <br />Mayor Crepeau opened the Public Hearing antl explained thet the purpose <br />of tha Hearing is to dtscuss the feasibitity and construction of <br />proposed improvement W-78-2, whTch consists of tnstahlatton of <br />watermain generally in the area north of t'-694, west of Hamtine Avenue. <br />_U <br />
