It is hereby found and detexmined by this Council that the <br />foregoing amen�nent to said proposed assessment is just and equit- <br />able, and necessary to a fair assessmenr for payment of the cost <br />o€ said improvement, <br />The motion for the adoption of the foregoing resolutian was <br />� duly seconded by olmen , and upon vo�e being <br />taken thereon, the following voted in favor thereof: A11 <br />and the followinq vos�ed agains� the same: None <br />whereupon said resolution was declared duly passed and adopted. <br />Clerk stromquist then introduced the following <br />resolution and moved ita adoption: <br />�E30LUTIO�T ADOPTING A1vD CONFIi2NIIffiG <br />_2EASSSSSMENTS FOR STREET IMPROVEMENT NO. 5 <br />BE IT RESOLVED by the Village Council of the Village of <br />Arden Hills, Minnesota, as follows: <br />1. The amount proper and necessary to be specially resssessed <br />at this time fox Street Improvement No. 5 against every asaesa- <br />able lot, piece or parcel of land aEfected thereby has been duly <br />calculated upon the basis of benefits, without regard to cash <br />vaivation, in accordance with the provisions of Minnesota Statutes, <br />Chapter 429, and notice has been duly published, as reqvired by law <br />that this Council would meet ta hear, consider and paas apon all <br />objections, if any, and said proposed reassessment has at all times <br />since its filing been open for public inspection, and an opportunity <br />hae been given to a13. interested persons to present their objections, <br />if any, to auch propoaed reassessments and said proposed reaesessment <br />has been amended as tco certain parcels of land, by resolution duly <br />adopted this date. <br />2. This Council, having heard and considered all objections so <br />presented, and being fully advised in the pr�nises, finds that each <br />of the lots, pieces and parceks of land enumerated in the propos�d <br />. reassessarent as so amended waa and is specially benefited by the <br />construction of said improvement in not less than the amount of the <br />reasse$ament set opposite the deacription of each such lot, piece and <br />parcel of land, respectively, and such amount so set out is hereby <br />levied against each of the res�pective lota, pieces and parcele of <br />Iand there3n described. <br />3. The proposed reassessment� as amended are hexeby adopted <br />and confirmed as the proper sp�cial assessments for each of said lots <br />pfecee and parcels of land respectively, and the reasses�ment against <br />each parcel, together with interest at the rate of 596 per annum <br />accruing on the full a�aount ther�f from time to time unpaid, aha11 <br />be a lien concurrent with qeneral taxes upon such parcel and all <br />thereof , <br />
