Motel. "Hotel" or "Motel" shall mean an establishment where food and <br />.,. ,',.0'" <br /> <br />lodging are regularly furnished to transients for a price. For specific requirements with <br /> <br />respect to a hotel prmotel, reference is made to the statutory requirements imposed thereon <br /> <br />by Section 340A.lOI Subdivision 13 of Minnesota Statutes as from time to time amended, <br /> <br />which provisions are incorporated herein by reference and made a part of this Code as if set <br /> <br />out here in full. ~: Again, the conflict with the zoning ordinance should not be <br /> <br />problematic as this follows the state definition for the purpose of alcohol. <br /> <br />Subd. 8 Intoxicating Liquor or Liquor. "Intoxicating Liquor" or "Liquor" shall mean <br /> <br />distilled, fermented, spirituous, vinous and malt beverages containing in excess of three and <br /> <br />two-tenths (3.2) percent of alcohol by weight. The term does not include ethyl alcohol or <br /> <br />neutral spirits or substitutes therefor possessing the taste, aroma, and characteristics <br /> <br />generally attributed to ethyl alcohol or neutral spirits. <br /> <br />Subd. 9 Off Sale. "Off Sale" shaH mean the retail sale of beer, rtIalt liquor, or liquor in <br /> <br />the original package for consumption away from the premises where sold. <br /> <br />Subd. 10 On Sale. "On Sale" shall mean the sale of beer, maltliqu6r, or liquor for <br />,."e .. <br /> <br />consumption on the premises only. <br /> <br />Subd.11 Original Package or Package. "Original Package" or "Package" shall mean any <br /> <br />corked or sealed container in which the beer, !!i'!!!:Jiqucjr, or liquor is placed by the <br /> <br />5-3 <br />
