Attorney Courtney stated that there Is nothing pending before the Council <br />~ at this tIme. Matter referred to the Clerk to so inform Mr. Allen. <br /> <br />FROM THE FLOOR <br /> <br />Land Fi I I Complaint <br /> <br />Mr. and Mrs. Lawrence McGough, 1666 Johanna Boulevard, "ere present and <br />stated their disapproval of the type of land fi II being dumped on the <br />Arden Hills Sportsman's Club property on the north side of johanna Blvd. <br />Mr. McGough, owner of the McGough Construction Company, informed the <br />Council that this type of fill cannot be dumped In any other Village; <br />they are forced to use a pay dump. He stated in his opInion this con- <br />stitutes a public nuisance as there Is no dirt content and also this <br />~=~er!al Is being dumped on Mrs. Meyers' property without her consent. <br />Trustee Crepeau, member of the Arden Hills Sportsman's Club, stated <br />that the owners of the property, namely: the Sportsman's Club, Ramsey <br />County and Robert AShbach, had given permission for this fil I and the <br />purpose of this filling Is to enable a road to be built over the swamp <br />to tne Sportsman's property. <br /> <br />Attorney Courtney Informed the residents that VI I lage Ordinance No.3 <br />prohibits dumping without the consent of the owner, but if the dumping <br />Is a public nuisance, this would constitute a violation of a State <br />Statute. <br /> <br />.. <br /> <br />Mayor Nethercut requested Attorney Courtney to check the Ordinances of <br />other Villages and also to review the Arden Hills Ordinance. <br /> <br />Mr. and Mrs. Blom, 3197 Shorewood Drive, were present. Mr. Blom ex- <br />pressed his concern about the same fill matter as mentioned above. His <br />concern being that the filling of this swamp would effect the control of <br />the level of Lake Johanna. Mrs. Blom informed the Council that four <br />families on Shorewood DrIve are now haclng water probleM' due to tha hlg~ <br />level of the alke and believes the water level should be controlled. <br /> <br />Engineer Don Lund stated that the County does control the level, but <br />did not know at what level Lake Johanna is set. <br /> <br />Cnuncl I requested the Clerk to check with the County Engineer for the <br />flow of excess swamp water and level controls. <br /> <br />-1- <br />
