~ ~~HILLS CITY OF ARDEl\' HILLS Ramsey County, Minnesota RESOLUTION No. 06-49 A Resolution Vacating the City of Ardcn Hills' Intcrest in A Pedestrian Walkway (Doc # 2257258) on the Section 22 Town 30 Range 23 Plat. WHEREAS, Royal Oaks Realty, Inc, has petitioned the City of Arden Hills to vacate an approximately 20 foot wide and 280 foot long Pedestrian Walkway Easement that is located at 1440- 1450 West Highway 96 in thc City of Arden Hills; and WHEREAS, on the 10th day of October, 2006, a publ ic hearing preceded by published, posted. and mailed notice as required by Minn. Stat. ~412.851 was conducted bcfore the Arden Hills Council; and WHEREAS, the pedestrian walkway easement docs not contain a trail and no trails are planned for the pedestrian walkway casement; and, WHEREAS, Royal Oaks Realty, Inc. has agreed to convey the trail along the westcrn edge . of the property to the City tor unobstructed public access; and, 'VHEREAS, at the conclusion of the Public Hearing, the Arden Hills Council dctermined that retcntion of the pedcstrian walkway casement is no longer in the public's interest; NOW, THEREFORE, BE IT RESOLVED that the Arden Hills Council hereby vacates the City's interest in the following described Pedestrian Walkway Easement: 1. That Pedestrian Walkway Easement filed under Document #2257258 on the Section 22 Town 30 Range 23 Plat. The legal description of the full propeliy is as t()I1ows: the Northeast Quarter of the Northwest Qumtcr of Section 22, . . Township 30. Range 23. Ramsey County. Minnesota, EXCEPT the South 3;4 thereof and except the east 253.00 feet thercof A~D BE IT FURTHER RESOLVED, that such Pedestrian Walkway Vacation shall be effective the day following publication in the Shoreview / Arden Hills Bulletin.
